In March 2000, following a criminal investigation during which an arsenal of weapons in a flat on the Nachtwachtlaan in Amsterdam were found, three individuals, K., Van S., and H., were convicted

    The Ukrainian Government (“the Government”) were represented by their Agent, Mr Y. Zaytsev. 3.

In 1995 and 1998 the State Archive of the Vinnytsia Region confirmed that Ms Y. had been rehabilitated posthumously and noted that there were no records concerning the confiscated property.

As a result, the State Bailiffs' Service terminated the enforcement proceedings in the applicants' cases and the writs of enforcement were forwarded to the liquidator.

The right to compensation under the impugned provision of the Code of Criminal Procedure vests in those persons who were convicted as a result of a miscarriage of justice, or persons who were deprived

    The applicants, who had been granted legal aid, were represented by Mr V. Kolomin, a lawyer practising in Moscow. The Russian Government (“the Government”) were represented by Mr P.

They were supposed to return on 28   September   2007 and had plane tickets purchased for that date.

    Mr Z. and Mr K. were arrested. Police questioned the persons who had provided this information or were eyewitnesses to the fight.

The Lithuanian Government (“the Government”) were represented by their Agent, Ms E. Baltutytė. 3.

The Bulgarian Government (“the Government”) were represented by their Agent, Ms M. Karadzhova, of the Ministry of Justice. 3.

    On 8 August 1999 the applicants and friends of theirs were holidaying beside a lake near Sofia. In turns, members of the group were riding a jetboat.

In the course of a subsequent search of the applicant’s house 1,500 dollars (USD) were seized. 8.

    The street race was ended by the police, who were present and eventually intervened. No arrests were made. 13.

In two further decisions dated 19 April 2000 and 18 April 2001 the land commission determined the value of the compensation the applicants were to receive.

    “Smirnov” and “Zhirkov” were called as witnesses and were examined during the trial, although their identity was kept secret. 40.

As regards non-pecuniary damage, the Government submitted that the claims were excessive and were not supported by any documents. 67.
