Nielsen , Section Registrar , Having regard to the above application lodged on 23 July 2003, Having regard to the decision to apply Article 29 § 3 of the Convention and examine the admissibility and merits of the case together. Having deliberated, decides as follows: THE FACTS The applicants, whose names are indicated in the annexed list, are Russian nationals who live in the city of Velikiye Luki, Pskov Region. They were initially represented before the Court by Mr D. Kozyrev, a lawyer practising in Pskov Region. The Russian Government (“the Government”) are represented by Mr P. Laptev, the Representative of the Russian Federation at the European Court of Human Rights. The applicants are teachers in municipal schools. In addition to their salary, they are entitled to receive regularly a special monetary allowance from the State. However, for several years this allowance was not paid to them. In 2002 the applicants brought proceedings claiming the outstanding amounts of that allowance. On 22 January 2003 the justice of the peace of Velikiye Luki satisfied their claims. The applicants were awarded the amounts indicated in the annex. On 20 March 2003 the first instance court of Velikiye Luki, acting as a court of appeal, upheld this judgment. Execution proceedings were initiated. However, for a long period of time the court judgment in the applicants’ favour remained unexecuted. In December 2005 the applicants informed the court that the decisions in their favour had been executed in full in April-May 2004. THE LAW In December 2005 the applicants submitted to the Court written statements to the effect that they wanted to withdraw their application because the outstanding amounts due to them had been paid by the authorities. They asserted that they did not have any other claims towards the State authorities in this respect. The Court recalls Article   37 of the Convention which, in the relevant part, reads as follows: “1. The Court may at any stage of the proceedings decide to strike an application out of its list of cases where the circumstances lead to the conclusion that (a) the applicant does not intend to pursue his application; ... However, the Court shall continue the examination of the application if respect for human rights as defined in the Convention and the Protocols thereto so requires.” The Court notes that the applicants do not intend to pursue their application. Furthermore, the Court considers that respect for human rights as defined in the Convention and its Protocols does not require it to continue the examination of the case. In these circumstances it considers that Article 29 § 3 of the Convention should no longer apply to the case and it should be struck out of the list in accordance with Article 37 § 1 (a) of the Convention.
