UKRAINE   (Application no. 54552/09 and 249 other applications)                     JUDGMENT     STRASBOURG   25 July 2013       This judgment is final. It may be subject to editorial revision. In the case of Khvorostyanoy and Others v. Ukraine, The European Court of Human Rights (Fifth Section), sitting as a Committee composed of:   Boštjan M. Zupančič, President,   Ann Power-Forde,   Helena Jäderblom, judges, and Stephen Phillips, Deputy Section Registrar, Having deliberated in private on 9 July 2013, Delivers the following judgment, which was adopted on that date: PROCEDURE 1.     The case originated in 250 applications (nos.   54552/09 and others) against Ukraine lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by Ukrainian nationals, whose details are specified in the appended tables (“the applicants”). 2.     On 23 January 2013 the applications were communicated to the Government. 3.     In applications nos.   22066/12 and 31336/12 the applicants died in course of the proceedings before the Court. Their next-of-kin expressed a wish to pursue the applications. 4.     The Ukrainian Government (“the Government”) were represented by their Agent, Mr Nazar Kulchytskyy. THE FACTS THE CIRCUMSTANCES OF THE CASE 5.     On the dates set out in the appended tables domestic courts delivered decisions according to which the applicants were entitled to various pecuniary amounts or to have certain actions taken in their favour. The decisions became enforceable. However, the applicants were unable to obtain the enforcement of the decisions in due time. 6.     Some of the applicants also made submissions concerning factual and legal matters unrelated to the above non-enforcement issues. THE LAW I.     ALLEGED VIOLATION OF ARTICLES 6 AND 13 OF THE CONVENTION AND OF ARTICLE 1 OF PROTOCOL No. 1 7.     All the applicants listed in appendices 1-6 complained about the lengthy non-enforcement of the judgments given in their favour and about the lack of effective domestic remedies in respect of those complaints. They relied on, expressly or in substance, Articles   6 § 1 and 13 of the Convention and Article 1 of Protocol   No.   1. A.     Admissible applications (Appendix 1) 8.     In view of the similarity of the applications listed in Appendix 1 in terms of the principal legal issue raised, the Court finds it appropriate to join them. 9.     The Court notes that the complaints of the applicants enumerated in Appendix 1 are not manifestly ill-founded within the meaning of Article 35 § 3 (a) of the Convention. It further notes that they are not inadmissible on any other grounds. They must therefore be declared admissible. 10.     The Court finds that the decisions in the applicants’ favour were not enforced in due time, for which the State authorities were responsible. 11.     Having regard to its well-established case-law on the subject (see Yuriy Nikolayevich Ivanov v. Ukraine , no. 40450/04, § §§ 56-58 and 66-70, 15 October 2009), the Court finds that in the applications listed in Appendix   1 there has been a violation of Article 6 § 1 of the Convention and Article   1 of Protocol No. 1 on account of the prolonged non-enforcement of the decisions in the applicants’ favour. It also considers that in those applications there has been a violation of Article 13 of the Convention in that the applicants did not have an effective domestic remedy to redress the damage created by such non-enforcement. B.     Inadmissible applications (Appendices 2-6) 12.     In view of the similarity of the applications listed in Appendices 2-6 in terms of the principal legal issue raised, the Court finds it appropriate to join them. 13.     The Court finds that the applications listed in Appendices 2-6 are inadmissible for the following reasons: 1.     Manifestly ill-founded applications (short period of delay in enforcement) (Appendix 2) 14.     The Court notes that in the applications listed in Appendix 2 the decisions of the domestic courts in the applicants’ favour remained unenforced for a certain period of time, for which the State authorities were responsible. However, in each case the period of non-enforcement attributed to the Government lasted not longer than one year and two months. The Court notes that in each case the period on non-enforcement is not so excessive as to raise an arguable claim under the Convention. Furthermore, it is observed that the judgment debts did not concern the applicants’ basic subsistence and there were no other special, urgent circumstances that would lead to the conclusion that the delay in the enforcement of the judgments was unreasonable. 15.     It follows that the applications listed in the Appendix 2 are manifestly ill-founded within the meaning of Article 35 § 3, and must be rejected pursuant to Article 35 § 4 of the Convention (see Soloshenko v.   Ukraine (dec.), no. 3952/04, 15 November 2005). 2.     Lack of significant disadvantage (Appendix 3) 16.     The Court notes that in applications nos. 56944/12 and 49659/12, the delay of enforcement concerned the payment of the relatively small awards (see Appendix 3 for details) and the applicants did not submit any arguments or evidence to suggest that the delay in the payment of such awards had a significant impact on their personal lives. The Court has previously found a lack of “significant disadvantage” in the cases, where the amount in question was equal or inferior to roughly EUR 500 (see, for instance, Gururyan v. Armenia (dec.), no. 11456/05, 24 January 2012 – the case of salary arrears of AMD 102,889 – the equivalent in euro was not given in the decision itself, but it was equivalent to approximately EUR   200; Ștefănescu v. Romania (dec.), no. 11774/04, 12 April 2011 – failure to reimburse EUR 125). The Court finds therefore that in present cases the applicants did not suffer any significant disadvantage as a result of the non-enforcement of the final judgments. 17.     The Court also notes that “the respect for human rights”, as defined in the Convention and the Protocols thereto, does not require examination of the present complaints on the merits, as the problem of non-enforcement of final decisions has already been addressed in the Court’s pilot judgment against Ukraine adopted in the case of Yuriy Nikolaevich Ivanov v. Ukraine (see Yuriy Nikolayevich Ivanov v. Ukraine , cited above) and in a number of other cases examined against Ukraine, which are moreover currently examined under “the well-established case-law procedure”. 18.     The Court further notes that the applicants’ cases were duly considered by domestic tribunals within the meaning of Article 35 § 3 (b) with the decisions favourable to the applicants. 19.     In view of the foregoing, the Court concludes that the applications nos. 56944/12 and 49659/12 (Appendix 3) should be rejected as inadmissible in accordance with Article 35 § 3 (b) of the Convention. 3.     Applications lodged outside of the six months period (Appendix 4) 20.     In the application no. 4893/12 the applicant informed the Court with a letter dated 24 October 2012 that the debtor company under the judgment was liquidated on 5 July 2007 as insolvent. 21.     In their objections to the application no. 25435/12 the Government showed that the decision of the domestic court was fully enforced on 30   June 2010 that is more than six months prior the date on which the applicant applied to the Court. 22.     The Court reiterates that in all the present cases the decisions of the domestic courts in the applicants’ favour remained unenforced throughout the lengthy periods of time, for which the State authorities were responsible. 23.     The Court further recalls that Article 35 of the Convention provides that the Court “may only deal with the matter... within a period of six months from the date on which the final decision was taken”. 24.     The Court notes that the purpose of this provision is to assure the compliance with the principle of legal certainty (compare and contrast, Nuzhdyak v. Ukraine , no. 16982/05, § 15, 28 May 2009). 25.     The Court finally notes that the applications listed in Appendix 4 were lodged more than six months after the end of the situations in which the State could be held responsible for the non-enforcement of the judgments. 26.     It follows that these applications must be rejected pursuant to Article   35 § 1 of the Convention as lodged too late. 4.     Complaints incompatible ratione personae (Appendix 5) 27.     In the applications 59320/12 and 59333/12 the applicants complain of lengthy non-enforcement of the judgment delivered in their favour by the courts of the first instance. 28.     In their objections the Government informed the Court (providing copies of the relevant documents) that the relevant decisions of the first instance courts were subsequently quashed by the courts of appeal and thus had not become enforceable and binding. 29.     The Court notes that the applicants do not have an enforceable and final judgment adopted in their favour and therefore they neither can complain of the lengthy non-enforcement of the judgments, nor can they claim to be victims of the alleged violations of their Conventional rights. 30.     It follows that the applications are incompatible ratione personae with the provisions of the Convention within the meaning of Article 35 § 3 (a) and must be rejected in accordance with Article 35 § 4. 5.     Manifestly ill-founded application (failure of the applicant to co-operate with the competent State authorities) (Appendix 6) 31.     In their objections the Government informed the Court that in the application no. 41703/12 they were obliged to provide the applicant with a land plot. On 6 July 2012 by a letter, copy of which is available to the Court, the applicant was invited to submit the necessary documents in order to initiate the allotment of the land plot. However, as appears from the case file, the applicant failed to do so. For this reason the Government consider that by lodging the application before this Court the applicant abuses his right of individual petition within the meaning of Article 35 § 3 of the Convention. 32.     The Court points out that in present case the enforcement of the judgment depended on the co-operation of the applicant with the relevant State authorities. 33.     The Court reiterates that only delays imputable to the authorities can justify a finding that a case (including the enforcement of the judgment) has lasted an unreasonably long time, contrary to Article 6 § 1 of the Convention (see, for example, Angelopoulos v. Greece , no. 49215/99, § 43, 11 April 2002; Kurt Nielsen v. Denmark , no. 33488/96, § 25, 15 February 2000). 34.     The Court observes that the applicant did not provide the State with the necessary documents, needed for the transfer of the land plot to his name. Therefore the domestic authorities cannot be held responsible for the lengthy non-enforcement of the judgment. 35.     It follows that the application no. 41703/12 is manifestly ill-founded within the meaning of Article 35 § 3 of the Convention and must be rejected in accordance with Article 35 § 4. II.     OTHER ALLEGED VIOLATIONS OF THE CONVENTION 36.     Some of the applicants raised other complaints under the Convention which the Court has carefully examined. In the light of all the material in its possession, and in so far as the matters complained of are within its competence, the Court finds that they do not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols. 37.     It follows that those complaints are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 3 (a) and 4 of the Convention. III.     APPLICATION OF ARTICLE 41 OF THE CONVENTION 38.     Article 41 of the Convention provides: “If the Court finds that there has been a violation of the Convention or the Protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparation to be made, the Court shall, if necessary, afford just satisfaction to the injured party.” 39.     In the present case, the Court considers it reasonable and equitable (see Kononova and Others v. Ukraine [Committee], no. 11770/03 and   89 other applications, §   24, 6 June 2013; Tsibulko and Others v. Ukraine [Committee], no. 65656/11 and   249 other applications, §   19, 20 June 2013; Pysarskyy and Others v. Ukraine [Committee], no. 20397/07 and   164 other applications, §   24, 20 June 2013) to award 2,000 euros (EUR) to each of the applicants in Appendix 1. This sum is to cover any pecuniary and non-pecuniary damage, as well as costs and expenses. 40.     The Court further notes that the respondent State has an outstanding obligation to enforce the judgments which remain enforceable. 41.     The Court considers it appropriate that the default interest rate should be based on the marginal lending rate of the European Central Bank, to which should be added three percentage points. FOR THESE REASONS, THE COURT, UNANIMOUSLY, 1.     Decides to join the applications set out in Appendix 1;   2.     Declares admissible the complaints of the applicants listed in Appendix   1 under Article 6 § 1 and Article 13 of the Convention and Article 1 of Protocol No. 1 about the lengthy non-enforcement of the decisions given in their favour and about the lack of effective domestic remedies in respect of those complaints, and declares inadmissible the remainder of the applications;   3.     Holds that in the cases listed in Appendix 1:   (a)     there has been a violation of Article   6 §   1 of the Convention and of Article 1 of Protocol No. 1; (b)     there has been a violation of Article   13 of the Convention; (c)     within three months the respondent State is to enforce the domestic decisions in the applicants’ favour which remain enforceable and is to pay EUR 2,000 (two thousand euros) to each applicant or his or her estate in respect of pecuniary and non-pecuniary damage and costs and expenses, plus any tax that may be chargeable to the applicants on the above amounts, which are to be converted into the national currency at the rate applicable at the date of settlement; (d)     that from the expiry of the above-mentioned three months until settlement simple interest shall be payable on the above amounts at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points;   4.     Decides to join the applications set out in Appendices 2-6 and to declare them inadmissible.
