It may be subject to editorial revision. In the case of Necheporenko and others v. Ukraine, The European Court of Human Rights (Fifth Section), sitting as a Committee composed of:   Boštjan M. Zupančič, President,   Ann Power-Forde,   Helena Jäderblom, judges, and Stephen Phillips, Deputy Section Registrar, Having deliberated in private on 1 October 2013, Delivers the following judgment, which was adopted on that date: PROCEDURE 1.     The case originated in 250 applications against Ukraine lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by Ukrainian nationals, whose details are specified in the appended tables (“the applicants”). 2.     The applicants Mr Nikolay Yevgenyevich Krasnobayev (applications nos.   54191/11 and 54192/11), Mr Mykhaylo Maksymovych Fedyayev (application   no.   57115/11), Mr Mykola Andriyovych Nesolyonyy (application no.   58812/11), Mr Ivan Petrovych Burliy (application no. 2109/12), Mr Leonid Sergiyovych Samoylenko (application no. 2121/12) and Mr Volodymyr Mykolayovych Gerasimov (application no. 50625/12) died. Their wife, Aleksandra Aleksandrovna Krasnobayeva (applications nos.   54191/11 and 54192/11), daughter, Ms Ella Mykhaylivna Fedyayeva (application no. 57115/11), daughter, Ms Tamara Mykolayivna Novokhatna (application   no.   58812/11), daughter, Ms Nataliya Ivanivna Gubska (application   no.   2109/12), wife, Ms Ganna Lukivna Samoylenko (application   no.   2121/12), wife Ms Tetyana Fedosiyivna Gerasymova (application no.   50625/12), respectively, manifested the wish to pursue the applications on their behalf. 3.     The Government (“the Government”) are represented by their Agent, Mr Nazar Kulchytskyy. 4.     On 13 February 2013 the applications were communicated to the Government. THE FACTS THE CIRCUMSTANCES OF THE CASE 5.     On the dates set out in the appended tables domestic courts and labour disputes commissions delivered decisions according to which the applicants were entitled to various pecuniary amounts or to have certain actions taken in their favour. The decisions became final and enforceable. However, the applicants were unable to obtain the enforcement of the decisions in due time. 6.     Some of the applicants also made submissions concerning factual and legal matters unrelated to the above non-enforcement issues. THE LAW I.     THE STANDING OF THE APPLICANTS IN APPLICATIONS Nos.   54191/11, 54192/11, 57115/11, 58812/11, 2109/12, 2121/12 and 50625/12 7.     The Court considers that the applicants’ heirs or next-of-kin in applications nos.   54191/11, 54192/11, 57115/11, 58812/11, 2109/12, 2121/12 and 50625/12 (see paragraph 2 above) have standing to continue the proceedings in the applicants’ stead (see, among other authorities, Mironov v. Ukraine , no. 19916/04, § 12, 14   December   2006). II.     ALLEGED VIOLATION OF ARTICLES 6 AND 13 OF THE CONVENTION AND OF ARTICLE 1 OF PROTOCOL No. 1 8.     The applicants complained about the lengthy non-enforcement of the decisions given in their favour and about the lack of effective domestic remedies in respect of those complaints. They relied on, expressly or in substance, Articles   6 § 1 and 13 of the Convention and Article 1 of Protocol   No.   1. A.     Applications set out in Appendix 1 9.     The Court considers the applications set out in Appendix 1 should be joined (save application no. 44587/12), given their common factual and legal background. 1.     Applications nos. 41828/11 and 44587/12 10.     The Government submitted in respect of application no. 41828/11 that on 26 November 2009 the Kharkiv Administrative Court of Appeal quashed the judgment of Avtozavodskyy District Court of Kremenchuk of 8   April   2009, which, accordingly, had remained subject to enforcement for seven months only. They further noted that the applicant had lodged his application one year and seven months after the annulment of the judgment and had failed, therefore, to observe the six-month time-limit. Given the above the Government claimed that the application should be declared inadmissible as manifestly ill-founded. The applicant did not argue. 11.     In their observations to application no. 44587/12 the Government submitted that the resolution of the Kharkiv Circuit Administrative Court of 15 October 2008 had become enforceable on 19 March 2009 and had been fully enforced in May 2009. They argued that the two-month duration of the enforcement was reasonable and that the applicant had lodged his application on 25 April 2012, i.e. two years and eleven months after the enforcement. They claimed that the application as it concerns non-enforcement of the resolution of the Kharkiv Circuit Administrative Court of 15 October 2008 was inadmissible pursuant to Article 35 §§ 1 and 3 of the Convention. The applicant did not dispute the fact that in May 2009 he had received the amounts awarded by the resolution 15 October 2008, but argued that the application was admissible. 12.     The Court agrees with the Government and declares application no.   41828/11 inadmissible and application no. 44587/12 partly inadmissible, pursuant to Article 35 § 3 (a) of the Convention. 2.     Applications nos. 53439/11 and 61796/11 13.     The Government submitted in their observations that the debtor in respect of the judgments at issue was a private legal entity. They maintained that the State was responsible for the non-enforcement in the applicants’ favour only insofar as the State Bailiffs’ Service was involved, while the applicants had not challenged before the domestic courts the Bailiffs’ alleged inactivity in the enforcement of their judgments. They further submitted that on 5 July 2007 the debtor’s activity had been terminated by a court due to bankruptcy and that the applicants had not challenged inactivity of the debtor’s liquidator before the domestic courts. The Government maintained that, taking into account the above, these applications were inadmissible as manifestly ill-founded. The applicants disagreed. 14.     The Court notes that other applications concerning the same debtor have already been declared inadmissible by the Court in the framework of the case of Shtabovenko and Others v. Ukraine ([Committee], no. 22722/07, § 15-16, 25 April 2013). The Court found, in particular, that there had been no factors, attributable to the State, which had impeded or blocked the enforcement of the judgments at issue and that the debtor had been finally liquidated more than six months before the introduction of the applications before the Court. The Court comes to the same conclusions in these applications and declares them inadmissible pursuant to Article 35 § 3 of the Convention. 3.     Application no. 183/12 15.     The Government submitted that the applicant’s domestic decision dated 20 October 2011 had been enforced by the debtor on 31 May 2012. Referring to the Court’s case-law (see Soloshenko v. Ukraine (dec.), no.   3952/04, 15 November 2005), they claimed that the seven-month duration of the enforcement was not unreasonable. They further noted that according to the Law “On State Budget for 2013” the minimum subsistence level amount for a person able to work was UAH 1,147, while the sum awarded to the applicant was UAH 475 (around 45 euros). They contended that the applicant had not suffered a significant disadvantage in view of the pettiness of his award. The Government finally considered that the application should be declared inadmissible on the basis of Article 35 § 3 of the Convention. The applicant did not argue. 16.     The Court agrees with the Government’s position that the application is manifestly ill-founded within the meaning of Article 35 § 3, and rejects it pursuant to Article 35 § 4 of the Convention (see, among many other authorities, Andreyenko and Others v. Ukraine (dec.), no. 22312/03, 19 June 2007; Gururyan v. Armenia (dec.), no. 11456/05, 24 January 2012). 4.     Application no. 2851/12 17.     The Government argued in their observations that the debtor in respect of this application was a private entity. They reiterated that the State’s responsibility for non-enforcement against private debtors was limited to the involvement of the State Bailiffs’ Service in the enforcement proceedings, while the applicant had failed to challenge before the domestic courts the Bailiffs’ actions or inactivity in the enforcement of her judgment. They further submitted that on 22 November 2004 the debtor had been declared insolvent and its liquidation had been ordered by a commercial court. They noted that the applicant had never requested the commercial court to acknowledge her as a creditor in the bankruptcy proceedings and that she had not challenged omissions of the debtor’s liquidator before courts. Given the above the Government claimed that the application should be declared inadmissible as manifestly ill-founded. The applicant did not reply to the Government’s objections. 18.     The Court observes that the documents, presented by the parties do not enable it to make a firm conclusion as to the status of the debtor. In any event, it transpires from the materials, submitted by the Government, that on 7 April 2006, that is more than six months before the application was lodged with this Court, the debtor had been finally liquidated without legal successor due to bankruptcy and excluded from the State companies register. Accordingly, this application must be rejected as manifestly ill-founded within the meaning of Article 35 § 3 of the Convention. 5.     Application no. 10118/12 19.     The Government submitted in respect of the above application that on 29 August 2012 the judgment of 22 February 2011 had been quashed by the Odesa Administrative Court of Appeal. They claimed that, nevertheless, the judgment had been fully enforced in April 2012, that is within one year and two months. In particular, the part of the judgment, concerning the applicant’s reinstatement and one-month salary payment, subject to immediate enforcement, was executed in March 2011. The remaining amount of the salary arrears was paid to the applicant in December 2011 and January 2012, while the other part of the award, non-pecuniary damages, was paid in April 2012. The Government maintained that such duration of the enforcement was not unreasonable and that, therefore, the application was manifestly ill-founded. The applicant confirmed that by the mid-March 2012 he had received the last payment under the judgment in question. 20.     The Court notes that the principal part of the award, salary arrears, was paid to the applicant in several installments, the last being paid within 10 months after the judgment had come into force. The overall length of the enforcement, including payment of non-pecuniary damages amounted to 11   months and 15 days. The Court considers that this period was not excessive and that this application is manifestly ill-founded within the meaning of Article 35 § 3, and must be rejected pursuant to Article 35 § 4 of the Convention (see Andreyenko and Others v. Ukraine (dec.), no.   22312/03, 19 June 2007; Zbaranskaya v. Ukraine (dec.), no. 43496/02, 11   October 2005). B.     Applications set out in Appendix 2 21.     In view of the similarity of the applications listed in Appendix 2 in terms of the principal legal issue raised, the Court finds it appropriate to join them. 22.     In their observations with respect to 27 applications, concerning the same debtor, the State-owned opened joint-stock company “Sodovyy Zavod”, the Government argued that the applicants did not suffer a significant disadvantage as the amounts awarded to them by the domestic decisions were lower than UAH 1,147 (around 110 euros), the minimum subsistence level for a person able to work, established by the Law “On the State Budget for the year 2013”. 23.     The Court notes that the domestic decisions in those 27 applications were delivered between 1997 and 2001 and concerned salary arrears for several months or years. At the material time the minimum salary was fixed between UAH 15 in 1997 and UAH 118 in 2001, while the lowest amount in question was UAH 463, awarded to the applicant in application no.   60239/12 in 1997. The Court, therefore, rejects the Government’s objection to the admissibility of those applications. 24.     The Court notes that the complaints of the applicants enumerated in Appendix 2 are not manifestly ill-founded within the meaning of Article 35 § 3 (a) of the Convention. It further notes that they are not inadmissible on any other grounds. They must therefore be declared admissible. 25.     The Court finds that the decisions in the applicants’ favour were not enforced in due time, for which the State authorities were responsible. 26.     Having regard to its well-established case-law on the subject (see Yuriy Nikolayevich Ivanov v. Ukraine , no. 40450/04, § §§ 56-58 and 66-70, 15 October 2009), the Court finds that in the applications listed in Appendix   2 there has been a violation of Article 6 § 1 of the Convention and Article   1 of Protocol No. 1 on account of the prolonged non-enforcement of the decisions in the applicants’ favour. It also considers that there has been a violation of Article 13 of the Convention in that the applicants did not have an effective domestic remedy to redress the damage created by such non-enforcement. III.     OTHER ALLEGED VIOLATIONS OF THE CONVENTION 27.     Some of the applicants raised other complaints under the Convention, which the Court has examined carefully. In the light of all the material in its possession, and in so far as the matters complained of are within its competence, the Court finds that they do not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols. 28.     It follows that those complaints are manifestly ill-founded and must be rejected in accordance with Article 35 §§ 3 (a) and 4 of the Convention. IV.     APPLICATION OF ARTICLE 41 OF THE CONVENTION 29.     Article 41 of the Convention provides: “If the Court finds that there has been a violation of the Convention or the Protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparation to be made, the Court shall, if necessary, afford just satisfaction to the injured party.” 30.     In the present case, the Court considers it reasonable and equitable (see Kononova and Others v. Ukraine [Committee], no. 11770/03 and 89   other applications, §   24, 6 June 2013; Tsibulko and Others v. Ukraine [Committee], no. 65656/11 and   249 other applications, §   19, 20 June 2013; Pysarskyy and Others v. Ukraine [Committee], no. 20397/07 and   164 other applications, §   24, 20 June 2013) to award 2,000 euros (EUR) to each of the applicants in Appendix 2 (with the exception of application no. 54124/11) and to the Applicant 2 in application no. 54124/11, Mr Mykola Sergiyovych Yerko, principal beneficiary under the domestic judgment. This sum is to cover any pecuniary and non-pecuniary damage, as well as costs and expenses. 31.     The Court further notes that the respondent State has an outstanding obligation to enforce the decisions which remain enforceable. 32.     The Court considers it appropriate that the default interest rate should be based on the marginal lending rate of the European Central Bank, to which should be added three percentage points. FOR THESE REASONS, THE COURT UNANIMOUSLY 1.     Decides to join the applications set out in Appendix 1 (save application no. 44587/12), and to declare them inadmissible;   2.     Decides to join the applications set out in Appendix 2;   3.     Declares admissible the complaints of the applicants listed in Appendix   2, under Article 6 § 1 and Article 13 of the Convention and Article 1 of Protocol No. 1 about the lengthy non-enforcement of the decisions given in their favour and about the lack of effective domestic remedies in respect of those complaints, and declares inadmissible the remainder of the applications;   4.     Holds that there has been a violation of Article   6 §   1 of the Convention and of Article 1 of Protocol No. 1;   5.     Holds that there has been a violation of Article   13 of the Convention;   6.     Holds (a)     that within three months the respondent State is to enforce the domestic decisions in the applicants’ favour which remain enforceable, and is to pay EUR 2,000 (two thousand euros) to each applicant or his or her estate in the applications enumerated in Appendix 2 (with exception of application no. 54124/11) and to Mr Mykola Sergiyovych Yerko in application no. 54124/11 in respect of pecuniary and non-pecuniary damage, and costs and expenses, plus any tax that may be chargeable to the applicants on the above amounts, which are to be converted into the national currency at the rate applicable at the date of settlement; (b)     that from the expiry of the above-mentioned three months until settlement simple interest shall be payable on the above amounts at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points.
