Zupančič,   Helena Jäderblom, judges, and Stephen Phillips, Deputy Section Registrar, Having regard to the above application lodged on 6 February 2013, Having deliberated, decides as follows: FACTS AND PROCEDURE The applicant, Mr Zoran Kolev, is a Macedonian national, who was born in 1963 and lives in Ljubljana. The Slovenian Government (“the Government”) were represented by their Agent, Mrs N. Pintar Gosenca. The Macedonian Government were informed of their right to intervene (Article 36 § 1 of the Convention and Rule 44 § 1 of the Rules of Court), however they did not avail themselves of that right. The applicant complained under Article 3 of the Convention about the material conditions of detention in the remand section of Ljubljana Prison and under Article 13 of the Convention about the lack of an effective domestic remedy in that regard. After the Government had been given notice of the application, the applicant informed the Court that he wished to withdraw his application introduced before the Court, as he will institute proceedings against the Republic of Slovenia at the domestic level. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
