The Serbian Government ("the Government") were represented by their Agent, Ms V. Rodić. Relying on various Articles of the Convention, the applicants complained about the respondent State’s failure to enforce final court decisions rendered in their favour against socially/State-owned companies. The essential information as to the domestic proceedings in respect of each application is indicated in the appended table. Between 2 December 2013 and 24 February 2014 the Court received friendly settlement declarations signed by the parties under which the applicants agreed to waive any further claims against Serbia in respect of the facts giving rise to these applications against an undertaking by the Government to pay each of them 2,000 EUR (two thousand euros) to cover any non-pecuniary damage as well as costs and expenses, which would be converted into local currency at the rate applicable on the date of payment, and would be free of any taxes that may be applicable. These sums would be payable within three months from the date of notification of the decision taken by the Court. In the event of failure to pay these sums within the said three-month period, the Government undertook to pay simple interest on them, from expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. The parties, furthermore, agreed that within the said three-month period the Government would pay, from their own funds, the sums awarded in the domestic decisions under consideration in the present cases (see table appended), less any amounts which may have already been paid on the basis of the said decisions, plus the costs of the domestic enforcement proceedings. These payments will constitute the final resolution of the cases pending before the European Court of Human Rights. THE LAW The Court considers that, in accordance with Rule 42 § 1 of the Rules of Court, the applications should be joined, given their similar factual and legal background. The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and its Protocols and finds no reasons to justify a continued examination of the applications. In view of the above, it is appropriate to strike the cases out of the list. For these reasons, the Court unanimously Decides to join the applications; Decides to strike the applications out of its list of cases in accordance with Article 39 of the Convention.   Marialena Tsirli   Ján Šikuta Deputy Registrar   President   APPENDIX No. Application no. and date of introduction Applicant name date of birth place of residence nationality Represented by Final domestic decision details Enforcement order details Constitutional Court decision details, amount awarded as a compensation for non-pecuniary damage   76651/12 19/11/2012 Budo MILOVANOVIĆ 03/02/1956 Serbian   Refija GARIBOVIĆ Aranđelovac 08/06/2006 11/05/2011 – enforcement requested before the Court of First Instance in Aranđelovac     13078/13 08/02/2013 Radica PEŠIĆ 14/09/1956 Serbian   Nenad ANTIĆ Vladicin Han 23/09/2003 26/05/2004 26/12/2003 25/06/2004     13096/13 08/02/2013 Jelica PEŠIĆ 14/09/1956 Serbian   Nenad ANTIĆ Vladicin Han 7/10/2003 26/05/2004 10/12/2003 25/06/2004     45226/13 17/05/2013 Zoran MLADENOVIĆ 17/05/1963 Serbian   Snežana JOKIĆ Čačak 26/12/2008 27/09/2011 (Inheritance decision - rešenje o nasleđivanju) 29/09/2009 Už-1748/2010 of 31 October 2012 300 Euros   46926/13 13/05/2013 Kruna IVANOVA 12/12/1969 Serbian     Bosilegrad 27/02/2008 29/04/2008     50405/13 15/05/2013 Svetlana RISTIC Serbian   Nenad ANTIĆ Vladičin Han 14/01/2008 12/02/2008     50411/13 15/05/2013 Ljubinka STOJKOVIĆ 16/06/1962 Serbian   Nenad ANTIĆ Vladičin Han 1. 22/10/2003 2. 25/02/2004   1, 30/12/2003 2. 19/03/2004     52811/13 22/07/2013 Sadija DAZDAREVIC 20/05/1966 Serbian   Hasim KLIMENTA Tutin 07/04/2003 04/06/2003     52821/13 31/07/2013 Slavoljub POPOVIĆ 13/12/1960 Serbian   Nenad ANTIĆ Vladičin Han 26/09/2003 29/01/2004 26/12/2003 22/03/2004     52825/13 31/07/2013 Dragan KOSTIC 17/08/1966 Serbian   Nenad ANTIĆ Vladičin Han 19/11/2003 03/03/2004 05/02/2004 15/04/2004     52849/13 26/07/2013 Mahit MURIĆ 03/07/1953 Serbian   Slobodan MILANOVIĆ Novi Pazar 1. 31/08/2004 2. 19/11/2009 1. 06/10/2004 2. 30/12/2009     57272/13 30/08/2013 Stanka GONEVA 21/10/1947 Serbian     Bosilegrad 10/12/2008 04/06/2009     57297/13 23/04/2013 Nada TRNAVAC 12/11/1952 Serbian   Snežana JOKIĆ Čačak 13/04/2007 21/09/2007 UŽ - 1706/2010 22/11/2012 - 500 EUR   60795/13 11/09/2013 Ifeta HOT 23/09/1957 Serbian   Hasim KLIMENTA Tutin 27/12/2002 28/01/2003     60796/13 11/09/2013 Dragoslav LEKOVIĆ 19/04/1949 Serbian   Hasim KLIMENTA Tutin 26/07/2004 25/11/2004     61909/13 22/08/2013 Zoran MITROVIĆ 28/07/1963 Serbian   Daroslava TODOROVIĆ Kraljevo 22/10/2003 21/01/2005 31/01/2008 01/04/2008     61927/13 22/08/2013 Slavica ZIVKOVIĆ 15/08/1952 Serbian   Daroslava TODOROVIĆ Kraljevo 30/03/2005 16/03/2006 16/01/2008 20/05/2008     61947/13 22/08/2013 Radovan VUKOSAVLJEVIĆ 30/09/1958 Serbian   Daroslava TODOROVIĆ Kraljevo 25/01/2005 16/03/2006 28/01/2008     61951/13 22/08/2013 Zoran MITROVIĆ 28/07/1963 Serbian   Daroslava TODOROVIĆ Kraljevo 24/01/2005 9/12/2005 30/01/2008     61963/13 22/08/2013 Miroslav STANČIĆ 04/07/1957 Serbian   Daroslava TODOROVIĆ Kraljevo 24/01/2005 16/03/2006 29/01/2008 2/04/2008     62214/13 25/09/2013 Abaz MAVRIĆ 01/03/1950 Serbian   Rodoljub MARINKOVIĆ Novi Pazar 1. 05/05/2008   1. 29/06/2011     62255/13 16/09/2013 Hajro ALIC 30/05/1955 Serbian   Emir FETAHOVIĆ Novi Pazar 1. 14/07/2004 2. 01/03/2006 3. 01/03/2006 4. 07/03/2007 1. 06/04/2007 2. 04/07/2006 3. 15/05/2006     62286/13 16/09/2013 Fatima ĐUKIĆ 14/07/1955 Serbian   Emir FETAHOVIĆ Novi Pazar 1. 29/05/2003 2. 29/12/2005 3. 10/11/2006 1. 04/08/2003 2. 24/08/2006 3. 30/03/2007       62297/13 16/09/2013 Zumreta BAJROVIĆ 02/07/1966 Serbian   Emir FETAHOVIĆ Novi Pazar 1. 08/02/2005 2. 24/11/2005 3. 11/09/2006 1. 14/01/2006 2. 26/04/2006 3. 08/06/2007         62301/13 16/09/2013 Izeta MUJOVIĆ 18/12/1955 Serbian   Emir FETAHOVIĆ Novi Pazar 1. 03/02/2005 2. 27/07/2006 3. 28/03/2007 1. 27/12/2005 2. 20/02/2007 3. 04/07/2007     62306/13 16/09/2013 Zumreta BAJROVIĆ 02/07/1966 Serbian   Emir FETAHOVIĆ Novi Pazar 1. 08/09/2004 2. 30/11/2005 3. 30/10/2006 1. 28/12/2005 2. 26/06/2006 3. 31/05/2007     62309/13 16/09/2013 Gordana MUTAVDŽIĆ 02/08/1964 Serbian   Emir FETAHOVIĆ Novi Pazar 1. 10/06/2004 2. 12/10/2005 3. 07/03/2007 1. 26/09/2005 2. 27/12/2005 3. 11/05/2007     62693/13 22/08/2013 Radovan VUKOSAVLJEVIĆ 30/09/1958 Serbian   Daroslava TODOROVIĆ Kraljevo 25/11/2003   25/01/2005 4/02/2008     64662/13 17/05/2013 Slobodanka JOVANČEVIĆ 03/10/1952 Serbian   Snežana JOKIĆ Čačak 02/10/2008 27/08/2009 17/06/2011 (Court of First instance in Čačak, inheritance decision - rešenje o nasleđivanju) UŽ - 1713/2010 18/10/2012 - 300 EUR  Citations
