The applicant’s complaints under Article 5   §   3 of the Convention concerning the excessive length of pre-trial detention were communicated to the Russian Government (“the Government”). On 13 June 2014 the Government informed the Registry that the applicant had died on 21 September 2011. By letters of 25 June and 22     September 2014, sent by registered post, the applicant’s relatives were requested to inform the Court whether they wished to pursue the proceedings before the Court. Their attention was drawn to Article   37   §   1   (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the application is not intended to be pursued. However, no response has been received. THE LAW In the light of the foregoing, the Court concludes that the applicant’s heirs do not wish to pursue the application within the meaning of Article   37   §   1   (a) of the Convention. Accordingly, the case should be struck out of the list.
