They were represented before the Court by Ms Figen Vural Sonmez, a lawyer practicing in Ankara. The Turkish Government (“the Government”) were represented by their Agent. Three of the applicants, namely, Mr Emin Ağduk, Mr Fahrettin Baran and Ramazan Balku died after lodging the present applications. Following the communication of the cases, their heirs, whose details are set out in the appendix, informed the Court that they wished to pursue the application in their stead. For practical reasons, Mr Emin Ağduk, Mr Fahrettin Boran and Mr Ramazan Balku will continue to be called as the “applicants” in this decision although their heirs are now to be regarded as such (see Dalban v.   Romania [GC], no. 28114/95, § 1, ECHR 1999-VI, and Çakar v. Turkey , no.   42741/98, § 2, 23 October 2003). At the date of lodging the applications, the applicants were employees at the Kozluk Municipality, Batman. A certain amount of money was deducted regularly from their salaries with a view to promoting their savings (“ tasarrufa teşvik kesintisi” ). However, the Municipality failed to pay back the amounts in question. The applicants accordingly brought actions before the Diyarbakır Administrative Court. In 2007, the Diyarbakır Administrative Court ordered the payment of the deducted amounts, plus interest to the applicants. In the absence of an appeal, the judgments became final. Despite the administrative court judgments and a payment order, the Kozluk Municipality did not make the payments. The cases were communicated under Article 6 § 1 of the Convention and Article 1 of Protocol No.   1 to the Convention. Following the communication of the cases, by a letter dated 3   October 2016, the applicants’ representative was requested to submit further factual information. In particular, she was invited to inform the Court about the outcome of the proceedings before the Compensation Commission, set up by Law no. 6384 of 9 January 2013. The representative’s attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike a case out of its list of cases where the circumstances lead to the conclusion that the applicants do not intend to pursue the applications. When the registered post arrived at her address, the applicants’ representative was not present. Notification was given that she should collect the registered mail from the post office. She failed to do so. THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. The Court considers that, in the given circumstances, the applicants may be regarded as no longer wishing to pursue their applications, within the meaning of Article   37   §   1   (a) of the Convention. Furthermore, in accordance with Article   37   §   1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the cases. In view of the above, it is appropriate to strike the cases out of the list.
