The applicant was represented by Ms K. S. Zaychenko, a lawyer practising in Kyiv. The case concerns the invalidation of the applicant’s title to a plot of land following a request by the prosecutor and its return to the State property. In that respect the applicant complained under Article 6 of the Convention and Article 1 of Protocol No. 1 to the Convention. The case was communicated to the Ukrainian Government on 28 October 2020 and their observations were received in August 2021. The Court’s attempts to establish contact with the applicant were unsuccessful. In particular, the applicant’s representative could not be reached by phone and the applicant himself provided no phone number. The Court’s letter sent by registered post in March 2024 to the address of the applicant’s representative returned as undelivered. The applicant has not contacted the Court since the date of lodging of the application. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article   37   §   1   (a) of the Convention, considers that it is no longer justified to continue the examination of the application (see Bryska and Others v Ukraine [Committee] (dec.), nos. 11706/13 and 5 others, 2 November 2023, and Zhadan and Others v Ukraine [Committee] (dec.), nos. 29283/13 and 26   others, 14 December 2023). Accordingly, the case should be struck out of the list. The Court reiterates that under Article 37 § 2 of the Convention it may decide to restore an application to its list of cases if it considers that the circumstances justify such a course. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 18 July 2024.     Viktoriya Maradudina   Carlo Ranzoni   Acting Deputy Registrar   PresidentCitations
