Un requérant a saisi la Cour européenne des droits de l'homme (CEDH) pour des griefs fondés sur les articles 8 et 14 de la Convention européenne des droits de l'homme concernant l'absence d'examen par les autorités nationales de sa demande d'acquisition de la nationalité depuis 2014. Le requérant était représenté par une avocate. Les griefs ont été communiqués au gouvernement défendeur. Les parties ont conclu un règlement amiable prévoyant le versement d'une somme ex gratia par le gouvernement au requérant, sous réserve de l'extinction de toute réclamation ultérieure.
Procédure
La CEDH a reçu les déclarations de règlement amiable signées par les parties. Le gouvernement s'est engagé à verser une somme déterminée dans un délai de trois mois à compter de la notification de la décision, avec application d'intérêts simples en cas de retard. Le paiement constitue la résolution définitive de l'affaire.

The applicant was represented by Ms N. Charalambidou, a lawyer practising in Nicosia. The applicant’s complaints under Articles 8 and 14 of the Convention concerning the continuing failure of the domestic authorities to examine the Turkish-Cypriot applicant’s application to acquire Cypriot citizenship since   2014 were communicated to the Cypriot Government (“the Government”). Complaints based on the same facts were also communicated under other provisions of the Convention. The Court received the friendly-settlement declarations, signed by the parties, under which the applicant agreed to waive any further claims against Cyprus in respect of the facts giving rise to this application, subject to an undertaking by the Government to pay him ex gratia the amount detailed in the appended table. This amount will be payable within three months from the date of notification of the Court’s decision. In the event of failure to pay this amount within the above-mentioned three-month period, the Government undertake to pay simple interest on it, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. The payment will constitute the final resolution of the case. THE LAW The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and the Protocols thereto and finds no reasons to justify a continued examination of the application. In view of the above, it is appropriate to strike the case out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases in accordance with Article   39 of the Convention.
