IAFaits
Plusieurs demandeurs ont saisi la Cour européenne des droits de l'homme (CourEDH) pour dénoncer des conditions de détention inadéquates et l'absence de recours effectif en droit interne, sur le fondement de l'article 3 de la Convention européenne des droits de l'homme. Les observations du Gouvernement roumain ont été transmises aux demandeurs, qui n'ont pas répondu malgré les invitations de la Cour. Des lettres recommandées ont été envoyées pour notifier l'expiration du délai de réponse et rappeler les conséquences possibles au titre de l'article 37 § 1 (a) de la Convention. Aucune réponse n'a été reçue par la Cour, et les lettres recommandées ont été soit reçues par les demandeurs ou leurs proches, soit retournées à la Cour.
Procédure
La CourEDH, siégeant en formation de Comité, a examiné les demandes conjointement en raison de leur objet similaire. Les demandeurs ont été invités à présenter leurs observations après communication des observations du Gouvernement, sans succès. La Cour a ensuite notifié aux demandeurs l'expiration du délai de réponse et les conséquences de leur inaction, conformément à l'article 37 § 1 (a) de la Convention.
Question juridique
La Cour européenne des droits de l'homme peut-elle poursuivre l'examen de demandes introduites par des demandeurs qui ne répondent pas à ses invitations à présenter des observations, malgré la communication des observations du Gouvernement défendeur ?

The applicants’ complaints under Article 3 of the Convention concerning the inadequate conditions of detention and the lack of any effective remedy in domestic law, were communicated to the Romanian Government, who submitted observations on the admissibility and merits. The observations were forwarded to the applicants, who were invited to submit their own observations (see the appended table for the relevant dates). No reply was received by the Court. By letters sent by registered post, the applicants were notified that the time allowed for the submission of their observations had expired (see the appended table for the relevant dates). The applicants’ attention was further drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. No reply to these letters has been received by the Court. The registered letters were either received by the applicants or the applicants’ relatives or were returned to the Court (see details in the appended table). THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article   37   §   1   (a) of   the Convention, considers that it is no longer justified to continue the examination of the applications. Accordingly, the applications should be struck out of the list of the Court’s list of cases. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
