IAFaits
Deux requêtes ont été introduites devant la Cour européenne des droits de l'homme (CEDH) par deux requérants contre l'Ukraine. Le premier requérant alléguait des violations de l'article 3 (conditions de détention) et de l'article 13 (absence de recours effectif) de la Convention européenne des droits de l'homme. Le second requérant alléguait des violations de l'article 6 § 1 (durée excessive des procédures pénales) et de l'article 13 de la Convention. Les deux requérants ont ensuite informé la Cour de leur souhait de retirer leurs requêtes avant toute décision au fond.
Procédure
La CEDH a communiqué les griefs des requérants au gouvernement ukrainien, qui a présenté des observations sur la recevabilité et le fond. Les représentants des requérants ont ensuite informé le greffe de la Cour de leur volonté de retirer les requêtes. La Cour a examiné les deux affaires conjointement en raison de leur similitude procédurale.

La Cour européenne des droits de l'homme peut-elle considérer que les requérants ne souhaitent plus poursuivre leurs requêtes et, en conséquence, radier les affaires de son rôle ?

The applicants’ complaints under the Convention were communicated to the Ukrainian Government (“the Government”), who submitted observations on the admissibility and merits. The applicants’ representatives informed the Registry that the applicants wanted to withdraw the applications before the Court since they were no longer interested in pursuing them (see appended table for details). THE LAW Having regard to the similar procedural conduct of the applicants, the Court finds it appropriate to examine them jointly in a single decision. In the light of the foregoing, the Court concludes that the applicants may be regarded as no longer wishing to pursue the application (Article   37   §   1   (a) of the Convention). Furthermore, in accordance with Article   37   §   1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application. Accordingly, the cases should be struck out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
