Des demandeurs, représentés par une avocate, ont introduit une requête devant la Cour européenne des droits de l'homme (CEDH) contre l'État grec. Leurs griefs portaient sur les articles 3, 13 et 14 de la Convention européenne des droits de l'homme et l'article 1 du Protocole n°1. La CEDH a communiqué ces griefs au gouvernement grec. Par lettre du 18 juin 2025, le gouvernement a invité la Cour à demander à la représentante des demandeurs de fournir la preuve de son contact avec eux et de leur volonté de poursuivre l'application. La Cour a ensuite invité la représentante, par lettre du 25 juin 2025, à soumettre ces informations avant le 9 juillet 2025. Aucune réponse n'a été reçue dans le délai imparti, malgré une demande d'extension accordée jusqu'au 15 septembre 2025.
Procédure
La CEDH a notifié aux parties la décision de radiation de l'affaire en application de l'article 37 § 1 (a) de la Convention, en l'absence de réponse des demandeurs ou de leur représentante malgré les relances. La décision a été prise à l'unanimité par un comité composé de trois juges.
Question juridique
La Cour européenne des droits de l'homme peut-elle radier une affaire de son rôle lorsque les demandeurs ou leur représentant ne fournissent pas les informations demandées dans le délai imparti, en application de l'article 37 § 1 (a) de la Convention ?

The applicants were represented by Ms E.-L. Koutra, a lawyer practising in Athens. The applicants’ complaints under Articles 3, 13 and 14 of the Convention and Article   1 of Protocol No. 1 were communicated to the Greek Government (“the Government”). By their letter dated 18 June 2025 the Government invited the Court to request the applicants’ representative to submit proof of contact with the applicants and confirmation that the latter wish to pursue their application. By letter dated 25 June 2025 the Registry invited the applicants’ representative to submit the said information by 9   July 2025. The   representative’s attention was further drawn to Article 37 §   1   (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. By letter dated 9 July 2025 the applicants’ representative requested an extension of the time-limit to submit the information requested by the Registry. By letter dated 18 July 2025, sent via the Court’s Electronic Communication Service (eComms), the applicants’ representative was granted an extension until 15   September 2025. The representative downloaded that letter from the eComms platform on the same day. However, no response has followed. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article   37   §   1   (a) of the Convention, considers that it is no longer justified to continue the examination of the application. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
