Quatorze demandeurs ont saisi la Cour européenne des droits de l'homme (CEDH) pour dénoncer des conditions de détention inadéquates et l'absence de recours effectif en droit interne, invoquant l'article 3 de la Convention européenne des droits de l'homme. Le gouvernement roumain a présenté des observations sur la recevabilité et le fond. Aucune réponse des demandeurs n'a été reçue par la Cour malgré les invitations à produire des observations. Des courriers recommandés ont été envoyés aux demandeurs ou à leurs proches, ou sont retournés à la Cour avec mention de changement d'adresse ou de non-réclamation.
Procédure
La CEDH a communiqué les griefs aux autorités roumaines et fixé un délai pour les observations des demandeurs. Aucune réponse n'ayant été reçue, la Cour a notifié aux demandeurs l'expiration du délai et les a informés de la possibilité de radiation des affaires au titre de l'article 37 § 1 (a) de la Convention. Les lettres recommandées ont été soit signées pour réception, soit retournées à la Cour.

The applicants’ complaints under Article 3 of the Convention concerning the inadequate conditions of detention and the lack of any effective remedy in domestic law, were communicated to the Romanian Government, who submitted observations on the admissibility and merits. The observations were forwarded to the applicants, who were invited to submit their own observations (see the appended table for the relevant dates). No reply was received by the Court. By letters sent by registered post, the applicants were notified that the time allowed for the submission of their observations had expired (see the appended table for the relevant dates). The applicants’ attention was further drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. No reply to these letters has been received by the Court. The registered letters were either received by the applicants or the applicants’ relatives or were returned to the Court (see details in the appended table). THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single judgment. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article   37   §   1   (a) of the Convention, considers that it is no longer justified to continue the examination of the applications. Accordingly, the cases should be struck out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
