Dix requérants ont saisi la Cour européenne des droits de l'homme (CEDH) pour dénoncer les conditions de détention et l'absence de recours effectif en droit interne, invoquant l'article 3 de la Convention européenne des droits de l'homme. Les observations du gouvernement roumain ont été transmises aux requérants, qui n'ont pas répondu dans les délais impartis. La CEDH a notifié aux requérants, par courrier recommandé, l'expiration du délai de réponse et les a informés de la possibilité de radiation de l'affaire au titre de l'article 37 § 1 (a) de la Convention. Aucun retour n'a été reçu par la Cour.
Procédure
La CEDH, statuant en comité, a joint les dix affaires en raison de leur objet similaire. Après avoir constaté l'absence de réponse des requérants et l'absence de circonstances particulières justifiant la poursuite de l'examen des affaires, la Cour a décidé de les radier de son rôle en application de l'article 37 § 1 (a) de la Convention.

The applicants’ complaints under Article 3 of the Convention concerning the inadequate conditions of detention and the lack of any effective remedy in domestic law, were communicated to the Romanian Government, who submitted observations on the admissibility and merits. The observations were forwarded to the applicants, who were invited to submit their own observations (see the appended table for the relevant dates). No reply was received by the Court. By letters sent by registered post, the applicants were notified that the time allowed for the submission of their observations had expired (see the appended table for the relevant dates). The applicants’ attention was further drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. No reply to these letters has been received by the Court. The registered letters were received by the applicants or the applicants’ relatives (see details in the appended table). THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article   37   §   1   (a) of the Convention, considers that it is no longer justified to continue the examination of the applications. Accordingly, the cases should be struck out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
