Cinq requérants ont saisi la Cour européenne des droits de l'homme (CEDH) pour dénoncer des conditions de détention inadéquates (violation alléguée de l'article 3 de la Convention) et l'absence de recours effectif en droit interne à cet égard (violation alléguée de l'article 13 de la Convention). Les requérants étaient représentés par deux avocats. Les griefs ont été communiqués au gouvernement grec. Les requérants ont ensuite informé le greffe de leur volonté de retirer leurs requêtes à différentes dates.
Procédure
La CEDH, statuant en formation de comité, a examiné conjointement les cinq requêtes en raison de leur objet similaire. Les requérants ont été informés de la possibilité de retirer leurs requêtes. La Cour a vérifié l'absence de circonstances exceptionnelles justifiant la poursuite de l'examen des affaires au regard du respect des droits de l'homme.

The applicants were represented by Mr K. Tsitselikis and Mr A. Spathis, two lawyers practising in Thessaloniki. The applicants’ complaints under Article 3 of the Convention concerning the inadequate conditions of detention, as well as under Article 13 of the Convention concerning the lack of any effective remedy in domestic law in respect of inadequate conditions of detention were communicated to the Greek Government (“the Government”). On the various dates indicated in the appended table the applicants informed the Registry that they wanted to withdraw the applications to the Court. THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. In the light of the foregoing, the Court concludes that the applicants may be regarded as no longer wishing to pursue the applications (Article   37   §   1   (a) of the Convention). Furthermore, in accordance with Article   37   §   1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the applications. Accordingly, the cases should be struck out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
