Le demandeur, représenté par un avocat, a introduit une requête devant la Cour européenne des droits de l'homme (CEDH) contre la République d'Albanie le 4 février 2025, invoquant des griefs au titre de l'article 6 de la Convention européenne des droits de l'homme. Le gouvernement albanais a soumis des observations sur la recevabilité et le fond. Le demandeur n'a pas répondu aux observations transmises ni demandé de prorogation de délai, malgré une notification par courrier recommandé et via le service électronique de la Cour le 18 novembre 2025, l'informant de l'expiration du délai et des conséquences possibles au regard de l'article 37 § 1 (a) de la Convention.
Procédure
La CEDH a communiqué les observations du gouvernement albanais au demandeur, qui a été invité à y répondre. Aucune réponse n'a été reçue dans le délai imparti. La Cour a ensuite notifié au demandeur et à son représentant l'expiration du délai et la possibilité de radiation de l'affaire au titre de l'article 37 § 1 (a) de la Convention, sans obtenir de réaction.
Question juridique
La Cour européenne des droits de l'homme peut-elle radier une requête de sa liste des affaires lorsque le demandeur ne manifeste plus l'intention de la poursuivre, en l'absence de réponse à ses observations et malgré une notification expresse des conséquences juridiques ?

She was represented by Ms   A. Sheri, a lawyer practising in Tirana. The applicant’s complaints under Article 6 of the Convention were communicated to the Albanian Government, who submitted observations on the admissibility and merits. The observations were forwarded to the applicant, who was invited to submit her observations in reply. The applicant did not respond. By letter sent by registered post and through the Court’s Electronic Communication Service (eComms) on 18 November 2025, the applicant and her representative were notified that the period allowed for submission of her observations had expired and that no extension of time had been requested. Their attention was further drawn to Article   37   §   1   (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. However, no response has followed. THE LAW In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1   (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto, which would require the continued examination of the application. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
