Le demandeur, représenté par un avocat, a saisi la Cour européenne des droits de l'homme (CEDH) contre la République tchèque. Il alléguait une violation des articles 3 et 8 de la Convention européenne des droits de l'homme, pris isolément ou conjointement avec l'article 14, en raison du refus des autorités tchèques de modifier ses données d'état civil concernant le genre, au motif qu'il n'avait pas subi de chirurgie irréversible. La CEDH a communiqué ces griefs au gouvernement tchèque.
Procédure
Les parties ont signé des déclarations de règlement amiable, par lesquelles le demandeur a accepté de renoncer à toute réclamation ultérieure contre la République tchèque pour les faits à l'origine de sa requête, sous réserve du versement par le gouvernement d'une somme d'argent détaillée dans un tableau annexé. Ces montants devaient être payés dans un délai de trois mois à compter de la notification de la décision de la CEDH. En cas de non-paiement dans ce délai, des intérêts simples seraient appliqués. Le paiement constituerait la résolution définitive de l'affaire.

The applicant was represented by Mr P. Kalla, a lawyer practising in Prague. The applicant’s complaints under Articles 3 and 8 of the Convention, taken alone or in conjunction with Article 14, concerning the authorities’ refusal to grant the applicant’s request to change the personal details denoting gender in the civil status records on the grounds that the applicant had not undergone irreversible surgery, were communicated to the Czech Government (“the   Government”). The Court received the friendly-settlement declarations, signed by the parties, under which the applicant agreed to waive any further claims against the Czech Republic in respect of the facts giving rise to this application, subject to an undertaking by the Government to pay him the amounts detailed in the appended table. These amounts will be payable within three months from the date of notification of the Court’s decision. In the event of failure to pay these amounts within the above-mentioned three-month period, the Government undertake to pay simple interest on them, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. The payment will constitute the final resolution of the case. THE LAW The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and the Protocols thereto and finds no reasons to justify a continued examination of the application. In view of the above, it is appropriate to strike the case out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases in accordance with Article   39 of the Convention.
