Le demandeur a saisi la Cour européenne des droits de l'homme contre la République d'Azerbaïdjan en invoquant des violations des articles 6 et 10 de la Convention européenne des droits de l'homme (droit à un procès équitable et liberté d'expression). Le gouvernement défendeur a répondu aux observations sur la recevabilité et le fond. Le demandeur a demandé et obtenu des prolongations de délai pour soumettre ses observations et sa demande d'indemnisation. Malgré plusieurs relances, aucune observation n'a été transmise à la Cour dans le délai imparti.
Procédure
La Cour a communiqué les griefs au gouvernement défendeur. Le demandeur, représenté par un avocat, a sollicité des extensions de délai à plusieurs reprises. La Cour a fixé un nouveau délai expirant le 8 janvier 2026, sans réception des observations requises. Une lettre de mise en garde a été envoyée au demandeur le 12 janvier 2026, l'informant de l'expiration du délai et de la possibilité de radiation de l'affaire en application de l'article 37 § 1 (a) de la Convention.

He was represented by Mr S. Rahimli, a lawyer practising in Baku. The applicant’s complaints under Articles 6 and 10 of the Convention concerning the alleged unfairness of the domestic proceedings and violation of the right to freedom of expression were communicated to the Azerbaijani Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicant, who was invited to submit his own observations. By a letter dated 15   December 2025, the applicant’s representative successfully asked the Court to extend the time-limit to submit observations and just satisfaction claims to 25   December 2025. From 25 to 30 December 2025 the applicant’s representative sent several letters to the Court, requesting short extensions. In reply, the Court set a new time-limit expiring on 8 January 2026 for the applicant to submit his observations and just satisfaction claims. The applicant’s representative received that letter. However, the Registry did not receive any such observations from the applicant by the deadline. By letter dated 12 January 2026, sent through the Court’s Electronic Communication Service (eComms), the applicant was notified that the period allowed for submission of the observations had expired on 8 January 2026 and that no further extension of time had been requested. The applicant’s attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The applicant’s representative received that letter on the same day. However, no response followed. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article   37   §   1   (a) of the Convention, considers that it is no longer justified to continue the examination of the application. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
