Une société commerciale a saisi la Cour européenne des droits de l'homme (CEDH) contre l'État géorgien pour des griefs relatifs à la saisie de ses actifs et à l'absence de recours effectif en droit interne, fondés sur l'article 1 du Protocole n°1 et l'article 13 de la Convention européenne des droits de l'homme. La société a informé la CEDH que la question sous-jacente avait été résolue au niveau national et qu'elle ne souhaitait plus poursuivre la procédure.
Procédure
La CEDH a communiqué les griefs de la société au gouvernement géorgien. La société a ensuite notifié à la CEDH, par lettre du 19 janvier 2024, que la matière litigieuse avait été réglée en interne et qu'elle renonçait à poursuivre l'instance. La CEDH a examiné la recevabilité et la persistance de l'intérêt à agir.

ILIYARD against Georgia (see appended table) The European Court of Human Rights (Fourth Section), sitting on 9   April 2026 as a Committee composed of:   Anne Louise Bormann , President ,   Sebastian Răduleţu,   András Jakab , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above application against Georgia lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) on 17   January 2023, Having deliberated, decides as follows: FACTS AND PROCEDURE The applicant company’s details are set out in the appended table. The applicant company was represented by Mr   V. Macharashvili, a lawyer practising in Tbilisi. The applicant’s complaints under Article 1 of Protocol   No.   1 and Article   13 of the Convention concerning the freezing of its assets and the lack of any effective remedy in domestic law were communicated to the Georgian Government (“the Government”), represented by their Agent, Mr   B. Dzamashvili, of the Ministry of Justice. On 19   January 2024 the applicant company informed the Registry that the matter underlying the application had been resolved at domestic level and it did not wish to pursue the application. THE LAW In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article   37   §   1   (a) of the Convention). Furthermore, in accordance with Article   37   §   1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
