He is currently detained in Timişoara Prison. The facts of the case, as submitted by the applicant, may be summarised as follows. On an unspecified date in 2013 the applicant was detained in Jilava Prison and Jilava Prison Hospital following a five years prison sentence. Subsequently, he was detained in Timişoara Prison. In his initial letter to the Court the applicant stated and submitted medical evidence attesting that he had been diagnosed with the human immunodeficiency virus (HIV) in 2007 and that he required treatment for his condition. In addition, he stated that he had not received the adequate medical treatment for his illness in any of the prisons he had been detained in on account of lack of funding. Consequently, his family had to provide him with the required treatment. Lastly, he also stated that in all the prison facilities he was detained in overcrowded and squalid cells which lacked sufficient air and light. Moreover, he was detained with smokers although he was a non-smoker. COMPLAINTS Relying on Article 3 of the Convention the applicant complains that he was subjected to inhuman and degrading treatment on account of the material conditions of detention, including the lack of separation between smokers and non-smokers, in Jilava Prison Hospital, Jilava and Timişoara Prisons. Invoking Article 2 of the Convention the applicant complains that his right to life had been breached because during his detention he had not received the required medical treatment for his HIV condition as a result of lack of funding.   QUESTION TO THE PARTIES Was the applicant subjected to inhuman and degrading treatment, in breach of Article 3 of the Convention, on account of: a)   the material conditions of detention, including the lack of separation between smokers and non-smokers, in Jilava Prison Hospital, Jilava and Timişoara Prisons; b)   the lack of adequate medical treatment during his detention because of lack of funding for his HIV condition?Citations
