padding-left:6.18pt; font-size:8pt } .s66053943 { text-transform:uppercase } Resolution CM/ResDH(2016)268 Execution of the judgments of the European Court of Human Rights Two hundred thirty-five cases against Russian Federation (See Appendix 1 for the list of cases)   (Adopted by the Committee of Ministers on 21 September 2016 at the 1265 th meeting of the Ministers’ Deputies)     The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),   Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violations established;   Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having noted that the just satisfaction, where awarded, has been paid by the government of the respondent State;   Noting with satisfaction the measures adopted by the Russian authorities to resolve the problem of non-enforcement of domestic judicial decisions concerning the State’s monetary obligations (see Appendix 2);   Recalling that the Court recognised the effectiveness of the remedy established in the Russian Federation for obtaining compensation in respect of non-enforcement of domestic judicial decisions concerning the State’s monetary obligations; judgments in the Timofeyev group of cases against Russian Federation   Scope of the Appendix   The Timofeyev group concerns the problem of non-enforcement of final domestic judgments, including the State’s failure to assist with effective enforcement of such judgments delivered against non-State parties. This appendix describes the measures taken by the authorities to execute the European Court’s judgments concerning those cases in which the domestic courts awarded the applicants monetary compensation against the State. For information on the other categories of cases (namely, lengthy non-enforcement of judicial decisions concerning the State’s obligations in kind, obligations of the State and municipal enterprises and of private parties), see the updated action plan submitted by the Russian authorities in July 2015 ( DH-DD(2015)772 ) in the context of the execution of the Gerasimov and Others pilot judgment.   I.   Case description   The Timofeyev group (235 cases falling within the scope of this appendix) concerns the failure to duly comply with final domestic judgments awarding monetary compensation to the applicants against the State authorities, the resulting violation of the applicants’ right to peaceful enjoyment of their possessions, and the lack of an effective remedy in this respect (violations of Articles 6 § 1, 13 and Article 1 of Protocol No. 1).   Other violations : In 22 cases, the Court also found violations of the principle of legal certainty on account of the quashing of final judicial decisions in the applicants’ favour by way of the supervisory-review procedure (Article 6 § 1) and violations of the applicants’ right to peaceful enjoyment of their possessions on this account (Article 1 of Protocol 1) ( Akashev, Alekseyeva, Azaryev, Bolyukh, Chistyakov, Isakov, Kozeyev, Kudrina, Kulkov, Kuzmin, Limasovy, Magomedov, Markovtsi, Osher and Osher, Sidorenko, Streltsov and Others, Sukhobokov, Tetsen, Almayeva, Finkov, Naydenkov, Viktor Petrov ) (this problem is considered in the Ryabykh group of cases). In two cases, the Court found violations of Articles 6 § 1 and 13 on account of the excessive length of civil proceedings and the lack of an effective remedy in this respect ( Gribanenkov and Suslin ) (this problem is considered in the Kormacheva group of cases).     II.   Individual measures   The Government of the Russian Federation has taken measures to ensure that the violations at hand have ceased and that the applicants have been redressed for the negative consequences.   In particular, in 43 cases where the European Court held that the respondent State should secure, by appropriate means, the enforcement of the awards made by the domestic court, the relevant amounts (internal debt) were paid to the applicants or their representatives (see below Appendix 3: list of payment of just satisfaction and of internal debt). Consequently, the domestic enforcement proceedings in these cases were brought to an end.   In 212 cases, where the European Court awarded just satisfaction, the relevant sums (including default interest) were also paid to the applicants or their representatives (see below Appendix 3). In 16 of them, there had been short and insignificant delays in the payment of just satisfaction. The interest amounts in these cases are very low and, to this date, the applicants have neither objected to the delay in payment nor requested the payment of interest amounts. It is therefore considered that the payments were made in conditions accepted by them.   In 18 cases ( Ayrapetyan, Bogdanov, Dvoryakov, Glebov and Glebova, Isakov, Kostenko, Larionov, Nadezhkin, Osher and Osher, Pellya, Pogulyayev, Sidorenko, Timofeyev, Troshev, Trunov, Ustalov, Veselyashkin and Veselyashkina, Yeldashev ), the European Court did not award just satisfaction due to the applicants’ failure to submit their claims for just satisfaction within the prescribed time-limits. According to the 2010 Compensation Act (see below: Measures aimed at preventing violations of Article 13 ), the applicants were provided with an opportunity to claim compensation for violations of their rights as found by the European Court.   As to the cases concerning excessively lengthy civil proceedings, it follows from the relevant judgments of the European Court that these proceedings had been terminated.   III.   General measures   In its judgment in the case of Burdov (No. 2) against the Russian Federation (application No. 33509/04), the Court noted that the violations were “the consequence of regulatory shortcomings and/or administrative conduct of the authorities in the execution of binding and enforceable judgments ordering monetary payments by State authorities” (§ 131). The problems underlying the non-enforcement of domestic judgments in the Russian Federation were addressed in detail in the Committee of Ministers’ documents CM/Inf/DH(2006)45 of 1 December 2006 and CM/Inf/DH(2006)19-rev3 of 4 June 2007. Among those were the bailiff’s inefficiency; the lack of coordination between various enforcement agencies; the lack of clarity in judgments to identify the debtor; the lack of funds on the debtor’s account; the non-availability of budgetary funds; and the lack of clarity as to the documents to be submitted to the Ministry of Finance.   In response to the European Court’s findings, a number of measures aimed at preventing similar violations have been taken. These measures are outlined below.   A) Measures aimed at preventing violations of Article 6   §   1   1. Legislative, regulatory and capacity-building measures   At its 1051 st meeting (DH) in March 2009, the Committee, on the basis of the information previously provided by the Russian authorities, adopted the Interim Resolution CM/ResDH(2009)43 which contains a detailed analysis and a summary of the achievements made before 2009. A brief overview of the measures is outlined below.   A specific procedure for execution of judicial decisions delivered against the State and its entities was introduced in 2005 in the Budgetary Code. A new federal Law on enforcement proceedings was adopted in 2007. Daily monitoring of enforcement of judgments delivered against the State and its entities was introduced by the Ministry of Finance’s Order No. 271 in 2006. In 2008, the Government of the Russian Federation adopted Resolution No. 579 on the form of the writ of execution, with a view to reducing the risk of execution documents being returned to claimants without execution.   The Administrative Rules on the execution by the Federal Treasury of court decisions delivered against budgetary institutions entered into force in 2009. They provide for uniform procedures of execution of court decisions for all territorial departments of the Federal Treasury; an exhaustive list of documents to be submitted by claimants and debtors in the framework of the execution of a court decision; personal liability of Federal Treasury employees for improper implementation of the procedures provided by the Rules; and a procedure for challenging actions or failures to act by the Federal Treasury. A monitoring procedure set up 2008 within the Federal Treasury made it possible to identify the principal authorities and geographical areas facing difficulties with timely execution of court decisions.   In 2006 the Supreme Commercial Court held that bailiffs have competence to initiate enforcement proceedings in respect of public authorities’ assets when such authorities fail to comply with judicial decisions after the expiry of the three-month period provided for by the Budgetary Code. In 2008 the President of the Russian Federation issued an order entrusting the bailiffs with a coordination role with regard to the execution of court decisions. Between 2004 and 2008 the number of bailiffs was increased by approximately one third and has remained at that level (see European Commission for the Efficiency of Justice (CEPEJ) Report on “European Judicial Systems – Edition 2014 (2012 Data): Efficiency and Quality of Justice”).   As regards the enforcement of court decisions in favour of Chernobyl victims, the uncertainty which previously existed as to the bodies responsible was eliminated by determining organs of social protection of the Russian Federation’s constituent entities or municipalities as being the responsible bodies.   In the above Interim Resolution the Committee of Ministers noted “the progress made by the competent Russian authorities in resolving the main structural problems underlying the violations, through: -           continuous improvement of the legislative and regulatory framework which resulted particularly in the setting up of execution and enforcement mechanisms; -           adoption of a number of organisational measures, thus ensuring better monitoring of the execution by the state and its entities of court decisions; -           reform of the budgetary regulations with a view to guaranteeing additional funding to avoid unnecessary delays in the execution of judicial decisions in case of shortfalls in the initial budgetary appropriations”.   The Committee of Ministers additionally noted “with satisfaction, that these measures are, to a certain extent, based on the proposals made in the Committee of Ministers’ documents (see in particular CM/Inf/DH(2006)19-rev3 and CM/Inf/DH(2006)45 ) and welcomed the authorities’ coordinated and interdisciplinary approach to their implementation”.   2. Publication and dissemination measures   The government has taken publication and dissemination measures in order to ensure that various State authorities are aware of the Convention standards concerning the enforcement of domestic judgments within a reasonable time. The judgments of the European Court were disseminated to all the authorities concerned, often with explanatory notes and recommendations. The judgments were also translated and published.   B) Measures aimed at preventing violations of Article 1 of Protocol No. 1   The government would like to indicate that the measures set out above, in particular those aimed at increasing efficiency of enforcement proceedings, are also relevant for prevention of violations of Article 1 of Protocol No. 1.   C) Measures aimed at preventing violations of Article 13   The law providing for a domestic remedy in case of excessive length of judicial and enforcement proceedings ("Compensation Act") entered into force on 4 May 2010. The European Court has characterised this remedy as effective in respect of non-enforcement of the domestic judgments awarding monetary compensation against State authorities (see, for example, Nagovitsyn and Nalgiyev case, decision of 23 September 2010; Gerasimov and Others , judgment of 01/07/2014, § 161; Krasnov , judgment of 22/11/2011, § 34). In November 2011 the Committee of Ministers adopted Interim Resolution CM/ResDH(2011)293 , by which it decided to close the examination of the issue relating to the introduction of an effective domestic remedy in this respect.   D) Assessment of the impact of the measures taken   The remaining concern of the Committee of Ministers, highlighted in Interim Resolution CM/ResDH(2009)43 , was that the major effects of the reforms undertaken were to be demonstrated. The measures described above have indeed resulted in the improved efficiency of the enforcement of decisions rendered by the domestic courts concerning the State’s monetary obligations. No violations have been established by the European Court in respect of any facts taking place since the adoption of the domestic remedy. Nor are there any pending communicated cases concerning such facts.   E) Other violations found   The general measures in response to the other violations found by the European Court in these cases (see the last paragraph in the case description) are examined within the context of the Ryabykh group (violation of the principle of legal certainty on account of the quashing of final domestic decisions in the applicants’ favour by way of the supervisory-review procedure) and the Kormacheva group (excessive length of civil proceedings).   IV.   Conclusions of the respondent State   The government considers that the measures adopted have fully remedied the consequences of the violations of the Convention found by the European Court in these cases and that these measures will prevent similar violations in future. The Russian Federation has, therefore, complied with its obligations under Article   46, paragraph 1, of the Convention.
