The decision to hospitalise him was based on the prosecutor’s request to verify the applicant’s fitness to be a defendant in criminal proceedings. The applicant complains of a violation Article 5 § 1 of the Convention. QUESTION tO THE PARTIES Was the applicant deprived of his liberty in breach of Article 5 § 1 of the Convention (see David v.
