border-left-style:solid; border-left-width:0.75pt; padding-right:5.03pt; padding-left:5.03pt; vertical-align:top } Resolution CM/ResDH(2017)289 Execution of the judgments of the European Court of Human Rights 119 cases against Italy   (Adopted by the Committee of Ministers on 21 September 2017 at the 1294 th meeting of the Ministers’ Deputies)   The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),   Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violations of Articles 6, paragraph 1 of the Convention and/or 1 of Protocol No. 1 established on account of the delay in the payments of sums awarded in the framework of a compensatory remedy (“Pinto”) available since 2001 to victims of excessively lengthy proceedings, and on account of the excessive length of “Pinto” proceedings;   Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having examined the information provided by the government (see documents DH-DD(2015)1123 and DH-DD(2017)750 ) ;   Having noted that the just satisfaction, where awarded, has been paid by the government and that, with a view to expediting them, the authorities brought to the attention of the relevant domestic courts the proceedings which had given rise to “Pinto” applications and were still ongoing when the judgments of the European Court became final;   Noting with satisfaction that, as of 1 st January 2016, the “Pinto” Act provides for the possibility to have recourse to additional funds once the budgetary resources earmarked for payments of “Pinto” compensation have been exhausted, preventing excessive delays in the payment;   Having noted that the allocation of additional funds to the Ministry of Justice in 2015-2017 and the assistance provided by the Bank of Italy in handling the payments have obtained significant results, particularly in the settlement of the arrears of the “Pinto” debt;   Having noted furthermore that a significant and constant reduction in the number of “Pinto” proceedings pending before courts of appeal and in their average length has been registered since 2012;   Underlining that the examination of the outstanding questions will be pursued in the context of the Olivieri and Others judgment, namely the 2012 reform of the “Pinto” remedy, which has notably restricted the access to the “Pinto” remedy and excluded any possibility of compensation for proceedings that have lasted six years or less, and the ineffectiveness of this remedy in cases of excessive length of administrative proceedings;
