In 1958, upon a cadastral survey, the disputed plots of land were registered in the land registry in the name of the applicants and the Treasury. On 2 August 1958, some individuals claiming to be the legal owner of the plots of land objected to the outcome of the survey before the cadastral court. On different dates between 1973 and 1986, when the proceedings before the cadastral court were still pending, some public administration authorities decided to expropriate the applicants’ plots of land. The expropriation decisions were notified by way of public announcements and/or to curators appointed by the domestic courts. The compensation for the said expropriation was deposited in bank accounts opened in the name of the prospective owners. On 29 June 2004 the Antalya Cadastral Court delivered a judgment ordering that some parts of the land in question be registered in the land registry as belonging to the applicants. After the said judgment became final on 31 July 2006, considering that their land had been expropriated de facto , the applicants initiated compensation proceedings before the civil courts. During these proceedings the applicants alleged that they had been neither notified of any expropriation decision nor received any expropriation compensation. However the civil courts dismissed the applicants’ claims. In their judgments they held, inter alia , that their land could not be considered as being de facto expropriated since there were formal expropriation decisions taken by the public authorities. The relevant details of the applications are set out in the appended table. The applicants complain under Article 1 of Protocol No. 1 to the Convention that despite the existence of a final judgment establishing their property rights over several plots of land, they were deprived of their land without receiving any compensation QUESTIONS to   THE PARTIES 1.     Did the Turkish law, as in force at the material time, require the public authorities to notify to the parties to the proceedings before the cadastral courts, concerning the ownership of the plots of land, about their decision to expropriate? The Government are invited to provide examples of such cases. 2.     Before lodging their compensation claims before the civil courts in 2006, did the applicants become aware of the fact that their plots of land had been expropriated and that the compensation for expropriation had been deposited in bank accounts opened in the name of the prospective owners? If so, when and how? 3.     What were the amounts of compensation deposited in the bank accounts opened in the name of the prospective owners? Have these amounts been increased following the proceedings initiated by the curators before the civil courts for additional compensation? 4.     Did the authorities apply default interest to the compensation for expropriation, deposited in the bank accounts opened in the name of the prospective owners? 5.     Did any of the applicants apply to the expropriating authorities or to the bank in order to collect the amounts for compensation? Are the compensation amounts still being held in those bank accounts and is it still possible for the applicants to collect their compensation? If yes, how? 6.     Have the applicants been deprived of their possessions in accordance with the requirements of Article 1 of Protocol No. 1 to the Convention? Did that deprivation impose an excessive individual burden on the applicants given the absence of compensation?   The parties are requested to submit copies of all relevant documents including those concerning whether any payment has been made to the applicants for expropriation of their plots of land.
