Un requérant a saisi la Cour européenne des droits de l'homme (CEDH) contre la Roumanie pour violation de ses droits garantis par la Convention européenne des droits de l'homme. La CEDH a rendu un arrêt le 13 décembre 2016, déclarant la violation de l'article 6 § 1 de la Convention (droit à un procès équitable) et de l'article 1 du Protocole n°1 (protection de la propriété). L'arrêt est devenu définitif le 13 mars 2017.
Procédure
Le Comité des Ministres du Conseil de l'Europe supervise l'exécution de l'arrêt conformément à l'article 46 § 2 de la Convention. L'examen a eu lieu lors de la 1312ème réunion des Délégués des Ministres le 4 avril 2018.
Question juridique
La question portait sur la conformité des mesures prises par la Roumanie pour exécuter l'arrêt de la CEDH et indemniser le requérant.
