border-left-width:0.75pt; padding-right:5.03pt; padding-left:5.03pt; vertical-align:top } Resolution CM/ResDH(2018)354 Execution of the judgments of the European Court of Human Rights 172 cases against Romania   (Adopted by the Committee of Ministers on 20 September 2018 at the 1324 th meeting of the Ministers’ Deputies)     The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),   Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violations of Article 6, paragraph 1, of the Convention and of Article 1 of Protocol No. 1 due to the ineffectiveness of the mechanism set up to afford restitution of or compensation for the properties nationalised under the communist regime; having regard also to the violations of Article 6, paragraph 1, in some cases due to the excessive length of civil proceedings, the quashing of final court decisions following extraordinary appeals lodged by the General Prosecutor or the failure by the domestic courts to address decisive arguments raised by the applicants in proceedings brought to recover the nationalised properties;   Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having examined the information regularly provided by the government indicating the individual measures adopted in order to give effect to the judgments including the information provided regarding the payment of the just satisfaction awarded by the Court;   Noting that the applicants have recovered the properties nationalised by the State, were offered equivalent properties or compensation at domestic level or received the just satisfaction awarded by the Court for pecuniary damage in the cases where restitution in kind of the original property was not possible; noting further that the proceedings found in breach of Article 6, paragraph 1, on account of their excessive length had ended by the time the Court gave the judgments;   Considering that the question of individual measures has therefore been resolved in all these cases;   Underlining that the closure of these cases in no way prejudges the Committee’s evaluation of the general measures in relation to the reform of the mechanism of reparation for properties nationalised under the Communist regime, to be pursued in the framework of the cases of Maria Atanasiu and Others and Străin and Others ;   Noting that the questions related to the excessive length of judicial proceedings, raised by the cases of Enyedi and Cherbeţiu and Pop , continue to be examined in the context of the supervision of the Vlad group of cases; Noting that the questions related to the powers of the General Prosecutor to lodge extraordinary appeals in civil disputes, raised by the cases of Petrini and Simionescu-Râmniceanu (No. 2) , were examined in the context of the supervision of the Brumărescu group of cases (Final resolution CM/ResDH(2007)90 );   Noting that the questions related to the failure by the courts to address decisive arguments brought by the parties to civil proceedings, raised in the case of Karl Gottfried and Helmut Martin Schwarz, were examined in the context of the supervision of the case of Vlasia Grigore Vasilescu (Final resolution CM/ResDH(2011)19 );   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases as regards the individual measures and   DECIDES to close the examination of these cases.
