A detailed description of the factual background of the case is set out in Arras and   Others v.   Italy   (no.   17972/07 ,   §§   7-25, 14 February 2012). In particular, the applicants are either pensioners or heirs of pensioners (retired prior to 31 December 1990) of the Banco di Napoli. Following its privatisation, the more favourable equalisation mechanism ( meccanismo perequativo ) was suppressed by Law 218/1990. According to a settled judicial interpretation, the suppression was considered inapplicable to persons who were already retired at the date of 31 December 1990. Nevertheless, the Banco di Napoli paid reduced amounts to the applicants, in application of the less favourable equalisation mechanism. Therefore, relying on the settled interpretation, the applicants entered into litigation with the Banco di Napoli and initially obtained favourable decisions. With the enactment of the contested legislation (section 1 paragraph 55 of Law no.   243/04), the less favourable equalisation mechanism was considered applicable also to persons retired before 31 December 1990, such as the applicants, notwithstanding pending judicial proceedings. Their claims were therefore dismissed on appeal and by the Court of Cassation. The applicants complain that section 1 paragraph 55 of Law no.   243/04 constituted a legislative interference with their pending proceedings, in breach of Article 6 of the Convention. QUESTIONS TO THE PARTIES Did the applicants listed in the appended table have a fair hearing in the determination of their civil rights and obligations, in accordance with Article   6 § 1 of the Convention? In particular, was there interference by the legislature with the administration of justice designed to influence the judicial determination of a dispute? If so, was the interference based on compelling grounds of general interest? Lastly, was the interference compatible with the principles of legal certainty (see Arras and Others v. Italy , no. 17972/07, 14   February 2012; Natale and Others v. Italy , no. 19264/07, 15 October 2013; and Casacchia and Others v.
