QUESTIONS TO THE PARTIES 1.     Have the authorities complied with their positive obligation enshrined in Articles 3 and 8 of the Convention to protect the applicant from domestic violence? In particular:   (a)   Having regard to the final judgment of 7 April 2023 of the Oradea Court of Appeal, was the system put in place by the Criminal Code and Law   no.   217/2003 on preventing and combating domestic violence, sufficient to allow the applicant’s protection and the prevention of further acts of domestic violence against her (see Bălșan v. Romania , no.   49645/09, §§   59 ‑ 71, 23 May 2017 and Ž.B. v. Croatia , no. 47666/13, § 47, 11   July 2017)?   (b)   Have the courts properly assessed the risk of physical and psychological violence against the applicant and the need to protect her in the proceedings concerning the breach of the protection order finalised with the judgment of 30 January 2023 of the Oradea Court of Appeal?   2.     Considering the above-mentioned final decisions of the Oradea Court of Appeal, has there been a violation of Article 14 of the Convention, taken in conjunction with Articles 3 and 8 of the Convention, in the applicant’s case on account of an alleged discrimination against women in matters concerning domestic violence (see Bălșan , cited above, §§ 72-89)?Citations
