The investigation into the events was opened in 1990 and appears to be still ongoing before the domestic authorities. After the delivery of the Court’s judgment in Mocanu and Others v. Romania ([GC], nos. 10865/09 and   2   others, ECHR 2014 (extracts)), some twenty-seven years after the events in question, fourteen individuals, including the former Heads of State and Government at the date of the events, were sent to trial for crimes against humanity. That decision was quashed by a judgment of 8   May 2019, which became final on 10 December 2020. Subsequently, a judge of the Preliminary Chamber of the High Court of Cassation and Justice ordered that the investigation be resumed at the prosecutorial level, while excluding from the file, for procedural reasons, all evidence collected until then. With a letter of 28 April 2023, the prosecutor informed the applicant about the judgment of May 2019 and that further evidence, in particular statements by victims and witnesses, was being collected. The applicant complains under Article 3 (procedural limb) of the Convention. QUESTIONS TO THE PARTIES 1.     Having regard to the procedural protection from inhuman or degrading treatment (see Mocanu and Others v. Romania [GC], nos. 10865/09 and   2   others, §§ 314-26, ECHR 2014 (extracts), and Ştefan-Gabriel Mocanu and Others v. Romania , nos.   34323/21 and 8 others, §§ 51-74, 12   December 2023), was the investigation in the present case compatible with the procedural requirements of Article 3 of the Convention?   2.     The Government are invited to submit factual information and relevant documents on the current state of the criminal investigations in respect of the applicant.Citations
