Un mineur migrant non accompagné, alléguant avoir été victime d'abus sexuels, a été hébergé dans un centre d'accueil pour adultes non adapté à son assistance. La Cour européenne des droits de l'homme a constaté une violation de l'article 3 de la Convention européenne des droits de l'homme en raison de cette situation.
Procédure
Le Comité des ministres du Conseil de l'Europe, agissant en vertu de l'article 46, paragraphe 2, de la Convention, supervise l'exécution du jugement final de la Cour européenne des droits de l'homme. Le gouvernement de l'État concerné a été invité à informer le Comité des mesures prises pour se conformer à l'obligation de réparation. La question des mesures individuelles a été considérée comme résolue, tandis que celle des mesures générales fait l'objet d'un examen dans le cadre d'une autre affaire (Darboe et Camara contre l'Italie).

Italy also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of these measures.   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case;   CONCLUDES that the question of individual measures was resolved;   DECIDES to continue to supervise the adoption of the necessary general measures required to guarantee the non-repetition of the violation of Article 3 in the case of Darboe and Camara v.
