Le Comité des ministres du Conseil de l'Europe, agissant en vertu de l'article 46, paragraphe 2, de la Convention européenne des droits de l'homme, supervise l'exécution d'un arrêt final de la Cour européenne des droits de l'homme rendu dans une affaire opposant des requérants à l'État défendeur. La Cour a constaté des violations liées à la durée excessive de la détention provisoire et à l'insuffisance du contrôle judiciaire. L'État défendeur a transmis un rapport d'action indiquant les mesures individuelles adoptées, notamment le paiement de la satisfaction équitable. La détention provisoire et les procédures de contrôle judiciaire des requérants ont pris fin avant le prononcé de l'arrêt.
Procédure
La Cour européenne des droits de l'homme a rendu un arrêt final le 16 janvier 2025 constatant des violations de la Convention. Le Comité des ministres a examiné le rapport d'action de l'État défendeur et a conclu que les mesures individuelles nécessaires avaient été adoptées. Il a décidé de poursuivre la supervision des mesures générales requises pour prévenir des violations similaires dans le cadre des groupes de cas Alparslan Altan et Akgün.

  Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having examined the action report provided by the government indicating the individual measures adopted to execute the judgment including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2025)1436 );   Considering that the question of individual measures was resolved, given that the applicants’ pre-trial detention and judicial review proceedings ended before the delivery of the judgment;   Recalling that the question of general measures required in response to the shortcomings found by the Court in this judgment continues to be examined within the framework of the Alparslan Altan and Akgün groups of cases, also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of the general measures in relation to the excessive length of pre-trial detention and of judicial review;   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case;   CONCLUDES that the necessary individual measures have been adopted;   DECIDES to continue to supervise the adoption of the necessary general measures concerning excessive length of pre-trial detention and of judicial review in the Alparslan Altan and Akgün groups of cases;
