  Having regard to the final judgment transmitted by the Court to the Committee in this case and to the violation established on account of the discretion afforded to the police by the former Code on Criminal Procedure to carry out searches without a judicial warrant;   Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having examined the action report provided by the government, indicating the measures adopted in order to give effect to the judgment including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2025)1435 );   Having noted the adoption of the current Code on Criminal Procedure, which entered into force in 2005 and remedied the structural shortcoming in the Turkish judicial system regarding the police discretion to carry out searches without a warrant; further noting the availability of pecuniary and non-pecuniary compensation before domestic criminal courts for damage resulting from unlawful searches, as well as the domestic case-law demonstrating that officials who conduct searches without the requisite authorisation are convicted of the offence of unlawful search under the Criminal Code;   Having also noted that the remaining issues in this group concerning violations arising from the implementation of the current Code on Criminal Procedure in respect of various forms of search will continue to be examined under the Kırdök and Others v. Turkey (14704/12) case and shortcomings regarding the administrative authorisation procedure continues to be examined under the Elvan v. Türkiye ( 64937/19 ) group of cases, and that the closure of the present case does not prejudge the Committee’s examination of the related general measures;   DECIDES to continue to supervise the adoption of the necessary general measures in respect of violations arising from the implementation of the current Code on Criminal Procedure in respect of various forms of search measures under the Kırdök and Others v. Turkey (14704/12) case and the shortcomings regarding the administrative authorisation procedure under the Elvan v. Türkiye ( 64937/19 ) case;   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case and   DECIDES to close the examination thereof.Citations
