Le Comité des ministres du Conseil de l'Europe examine l'exécution du jugement de la Cour européenne des droits de l'homme dans l'affaire opposant un parti politique à l'État turc. La Cour avait constaté une violation de l'article 11 de la Convention européenne des droits de l'homme en raison de la dissolution d'un parti politique fondée sur les activités et déclarations de certains de ses membres, jugées comme transformant le parti en un centre d'activités illégales. Le jugement était définitif depuis le 14 mars 2011.
Procédure
Le Comité des ministres, agissant en vertu de l'article 46, paragraphe 2, de la Convention, supervise l'exécution des jugements définitifs de la Cour européenne des droits de l'homme. L'État turc a été invité à informer le Comité des mesures prises pour se conformer à l'obligation de réparation, incluant des mesures individuelles et générales. Un rapport d'action a été examiné, mentionnant notamment une modification législative augmentant la majorité requise au sein de la Cour constitutionnelle pour ordonner la dissolution d'un parti politique.

Dans quelle mesure les mesures adoptées par l'État turc permettent-elles de se conformer à l'obligation de réparation découlant du jugement de la Cour européenne des droits de l'homme, notamment en ce qui concerne la dissolution de partis politiques ?

Turkey (3840/10) group, also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of the outstanding general measures;   Having satisfied itself that all the measures required by Article 46, paragraph 1, have been adopted,   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case and   DECIDES to close the examination thereof.Citations
