Le Comité des ministres du Conseil de l'Europe, en application de l'article 46, paragraphe 2, de la Convention européenne des droits de l'homme, supervise l'exécution d'un arrêt final de la Cour européenne des droits de l'homme rendu dans une affaire contre l'État défendeur. La Cour a constaté une violation due à la durée excessive des procédures civiles devant la Cour constitutionnelle. Le gouvernement de l'État défendeur a transmis un rapport d'action indiquant les mesures individuelles adoptées, notamment le paiement de la satisfaction équitable allouée par la Cour.
Procédure
L'affaire a été transmise à la Cour européenne des droits de l'homme, qui a rendu un arrêt final le 10 juillet 2025 constatant une violation de la Convention. Le Comité des ministres a examiné le rapport d'action du gouvernement de l'État défendeur et a évalué les mesures individuelles et générales nécessaires pour se conformer à l'arrêt. La question des mesures individuelles a été considérée comme résolue, tandis que celle des mesures générales fait l'objet d'un examen dans le cadre d'un groupe de cas similaire.

Türkiye (23393/23) group of cases also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of the general measures in relation to the excessive length of civil proceedings before the Constitutional Court .   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case;   CONCLUDES that the necessary individual measures have been adopted;   DECIDES to continue to supervise the adoption of the necessary general measures concerning excessive length of civil proceedings before the Constitutional Court within the framework of the Ayvaz. v. Türkiye group of cases;   DECIDES to close the examination of this case.Citations
