Le Comité des ministres du Conseil de l'Europe, en application de l'article 46, paragraphe 2, de la Convention européenne des droits de l'homme, supervise l'exécution d'un arrêt final de la Cour européenne des droits de l'homme. La Cour a constaté une violation en raison de la mesure de surveillance et d'enregistrement des entretiens entre le demandeur et son avocat en prison. L'État défendeur a été invité à informer des mesures prises pour se conformer à cette obligation. Le rapport d'action de l'État indique que des mesures individuelles ont été adoptées, notamment le paiement de la satisfaction équitable. Le demandeur a été libéré de prison.
Procédure
La Cour européenne des droits de l'homme a rendu un arrêt final le 24 septembre 2024 constatant une violation. Le Comité des ministres examine l'exécution de cet arrêt. L'État défendeur a fourni un rapport d'action (document DH-DD(2025)1052) détaillant les mesures individuelles adoptées. La question des mesures générales est examinée dans le cadre d'un groupe de cas (Demirtaş et Yüksekdağ Şenoğlu, 10207/21).

  Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having examined the action report provided by the government indicating the individual measures adopted to execute the judgment including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2025)1052 );   Considering that the question of individual measures was resolved, given that the applicant has been released from prison;   Recalling that the question of general measures required in response to the shortcomings found by the Court in this judgment continues to be examined within the framework of the Demirtaş and Yüksekdağ Şenoğlu (10207/21) group of cases, also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of the general measures in relation to monitoring and recording of prisoners’ meetings with their lawyers;   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case;   CONCLUDES that the necessary individual measures have been adopted;   DECIDES to continue to supervise the adoption of the necessary general measures concerning monitoring and recording of prisoners’ meetings with their lawyers in the Demirtaş and Yüksekdağ Şenoğlu group of cases;
