Deux affaires contre l'Arménie ont fait l'objet de jugements finaux de la Cour européenne des droits de l'homme (CEDH) les 19 mars 2020 et 28 février 2022. Les violations établies concernent l'absence d'enquêtes effectives menées par les autorités nationales dans les décès des proches des requérants, en violation de l'article 2 de la Convention européenne des droits de l'homme.
Procédure
Le Comité des ministres du Conseil de l'Europe, agissant en vertu de l'article 46, paragraphe 2, de la Convention, supervise l'exécution des jugements finaux de la CEDH. L'Arménie, État défendeur, a été invitée à informer le Comité des mesures prises pour se conformer à ses obligations. Un rapport d'action a été examiné, incluant les mesures adoptées pour donner effet aux jugements et le paiement de la satisfaction équitable accordée par la CEDH.

L'État défendeur a-t-il adopté les mesures individuelles et générales nécessaires pour mettre fin aux violations établies et prévenir leur renouvellement, conformément à l'article 46, paragraphe 1, de la Convention européenne des droits de l'homme ?

  Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violations established on account of the failure of the authorities to conduct effective investigations into the deaths of the applicants’ relatives (Article 2 of the Convention);   Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having examined the action report provided by the government, indicating the measures adopted in order to give effect to the judgments including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2025)1101 );   Having satisfied itself that all the measures required by Article 46, paragraph 1, have been adopted,   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases and   DECIDES to close the examination thereof.Citations
