IAFaits
Deux affaires contre la Bulgarie ont fait l'objet de jugements finaux de la Cour européenne des droits de l'homme (CEDH) les 15 mars 2022 et 2 février 2017. La CEDH a constaté une violation en raison de retards injustifiés dans la fourniture de compensations sous forme d'appartements ou de garages, promises par les autorités en compensation de l'expropriation des biens des requérants.
Procédure
Le Comité des ministres du Conseil de l'Europe, agissant en vertu de l'article 46, paragraphe 2, de la Convention européenne des droits de l'homme, supervise l'exécution des jugements finaux de la CEDH. Le gouvernement bulgare a été invité à informer le Comité des mesures prises pour se conformer à ses obligations. Un rapport d'action a été examiné, indiquant les mesures individuelles adoptées, notamment le paiement de la satisfaction équitable accordée par la CEDH.
Question juridique
La question juridique porte sur la conformité des mesures individuelles et générales prises par l'État défendeur pour exécuter les jugements de la CEDH, notamment en ce qui concerne la fin des violations constatées et la prévention de violations similaires.

  Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having examined the action report provided by the government indicating the individual measures adopted to execute the judgments including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2025)1415 );   Considering that the question of individual measures was resolved, given that: (i)                    the just satisfaction awarded by the Court to the applicants for the delays was paid; (ii)                  the Court concluded that, after the date when the applicants became aware that the construction of flats/ garages due to them would not proceed, they had at their disposal means to unblock the compensation procedure, which was a possibility that was still open;   Recalling that the question of general measures required in response to the shortcomings found by the Court in these judgments continues to be examined within the framework of the Basmenkova group of cases also in the light of the Court’s findings in these cases, and that the closure of these cases therefore in no way prejudges the Committee’s evaluation of the general measures required;   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases;   CONCLUDES that the question of the individual measures has been resolved;   DECIDES to continue to supervise the adoption of the necessary general measures in the Basmenkova group of cases;
