IAFaits
Huit affaires contre l'État ukrainien ont fait l'objet de jugements définitifs de la Cour européenne des droits de l'homme entre le 28 janvier 2021 et le 14 novembre 2024. Les violations établies concernent : l'insuffisance des soins médicaux en détention et l'absence de recours effectifs, les conditions de détention inadéquates et l'absence de recours effectifs, la durée excessive de la détention provisoire et la durée excessive des procédures pénales.
Procédure
Le Comité des ministres du Conseil de l'Europe, en application de l'article 46, paragraphe 2, de la Convention européenne des droits de l'homme, supervise l'exécution des jugements définitifs. L'État ukrainien a été invité à informer le Comité des mesures prises pour se conformer à ses obligations. Un rapport d'action a été examiné, indiquant les mesures individuelles adoptées, notamment la libération des demandeurs et la clôture des procédures internes.

  Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having examined the action report provided by the government indicating the individual measures adopted to execute the judgments including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2025)1110 );   Considering that the question of individual measures was resolved, given that the applicants have been released from detention and the domestic proceedings have been terminated (in Ladan and Gultyayev in respect of the applicant concerned);   Recalling that the question of general measures required in response to the shortcomings found by the Court in this these judgments continues to be examined within the framework of the Logvinenko , Nevmerzhitsky , Ignatov and Merit groups of cases also in the light of the Court’s findings in these cases, and that the closure of these cases therefore in no way prejudges the Committee’s evaluation of the general measures in relation to the inadequate medical care in detention and the lack of effective remedies thereof, the inadequate conditions of detention and the lack of effective remedies thereof, the excessive length of pre‑trial detention, and the excessive length of criminal proceedings;   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases;   CONCLUDES that the necessary individual measures have been adopted;   DECIDES to continue to supervise the adoption of the necessary general measures concerning the inadequate medical care in detention and the lack of effective remedies thereof in the Logvinenko group of cases, the inadequate conditions of detention and the lack of effective remedies thereof in the Nevmerzhitsky group of cases, the excessive length of pre‑trial detention in the Ignatov group of cases, and the excessive length of criminal proceedings – in the Merit group of cases;
