En 2016, le demandeur a acquis une copropriété sur un terrain par un contrat de vente, enregistrée dans un registre public. Par la suite, la municipalité locale a construit une route sur une partie de ce terrain sans compenser le demandeur. Le demandeur a engagé des poursuites civiles en indemnisation, mais la Cour d'appel de Novi Sad a rendu un jugement définitif le 5 novembre 2020 le déboutant. La Cour constitutionnelle a ensuite rejeté son recours constitutionnel par une décision du 2 juillet 2025. Le demandeur invoque l'article 1 du Protocole n°1 à la Convention européenne des droits de l'homme.
Procédure
Le demandeur a saisi la Cour européenne des droits de l'homme (CEDH) le 17 octobre 2025 (requête n°33449/25), communiquée au défendeur le 18 mars 2026. La question juridique porte sur une éventuelle violation de l'article 1 du Protocole n°1 à la Convention, notamment en ce qui concerne la privation de biens dans l'intérêt public et le respect des conditions légales.

In 2016, the applicant obtained a co ‑ ownership on a certain piece of land by way of a purchase contract which co-ownership was registered in relevant public registry. Subsequently, the local municipality built a road on part of that land without compensating the applicant. The applicant initiated civil proceedings for compensation in which the Novi Sad Court of Appeals ruled against him by a final judgment of 5   November 2020. Ultimately, the Constitutional Court dismissed his constitutional appeal by a decision of 2 July 2025. The applicant relies on Article 1 of Protocol No. 1 to the Convention. QUESTION TO THE PARTIES Has there been a violation of Article 1 of Protocol No.   1 to the Convention?
