Le Comité des ministres du Conseil de l'Europe examine l'exécution du jugement de la Cour européenne des droits de l'homme dans l'affaire Bumbeș contre la Roumanie. La Cour a constaté une violation de l'article 10 de la Convention européenne des droits de l'homme en raison d'une ingérence injustifiée dans la liberté d'expression, consécutive à l'imposition d'une amende pour la participation du demandeur à une manifestation pacifique et de courte durée. Le gouvernement roumain a informé le Comité des mesures individuelles adoptées, notamment le paiement de la satisfaction équitable accordée par la Cour. La question des mesures générales reste examinée dans le cadre du groupe de cas Chitic contre la Roumanie.
Procédure
La procédure relève du contrôle de l'exécution des arrêts de la Cour européenne des droits de l'homme par le Comité des ministres, conformément à l'article 46, paragraphe 2, de la Convention. Le Comité a examiné le rapport d'action fourni par le gouvernement roumain et a pris acte des mesures individuelles adoptées. La question des mesures générales est suivie dans le cadre d'un autre groupe de cas (Chitic contre la Roumanie).

Romania (Application No. 6512/13) group of cases also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of the general measures concerning the unjustified interference with the freedom of expression due to the imposition of fines during political demonstrations;   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case;   CONCLUDES that the question of individual measures has been resolved;   DECIDES to continue to supervise the adoption of the necessary general measures concerning the unjustified interference with the freedom of expression due to the imposition of fines during political demonstrations in the case of Chitic v. Romania group of cases (Application No. 6512/13);   DECIDES to close the examination of this case.Citations
