IAFaits
Le Comité des ministres du Conseil de l'Europe, agissant en vertu de l'article 46, paragraphe 2, de la Convention européenne des droits de l'homme, supervise l'exécution d'un arrêt final de la Cour européenne des droits de l'homme rendu dans une affaire opposant un requérant à l'État albanais. La Cour a constaté une violation due au retard dans l'exécution d'une décision judiciaire interne définitive. L'État albanais a été invité à informer le Comité des mesures prises pour se conformer à ses obligations. Le paiement de la satisfaction équitable allouée par la Cour a été effectué. La décision judiciaire interne a été exécutée avant que la Cour ne rende son arrêt.
Procédure
La procédure relève du contrôle de l'exécution des arrêts de la Cour européenne des droits de l'homme par le Comité des ministres. L'État albanais a fourni des informations sur les mesures prises, notamment le paiement de la satisfaction équitable. Le Comité a examiné si les mesures individuelles étaient suffisantes et a décidé de poursuivre la supervision des mesures générales dans le cadre du groupe d'affaires Brahimaj.

  Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having noted the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2026)361 );   Considering that the question of individual measures was resolved, given that the domestic final judicial decision was executed before the European Court delivered its judgment and that the just satisfaction awarded by the European Court has been paid;   Recalling that the question of general measures required in response to the shortcomings found by the Court in this judgment continues to be examined within the framework of the Brahimaj group of cases also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of the general measures required;   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case;   CONCLUDES that the question of individual measures has been resolved;   DECIDES to continue to supervise the adoption of the necessary general measures in the Brahimaj group of cases ;
