IAFaits
Le Comité des ministres du Conseil de l'Europe examine l'exécution d'un arrêt final de la Cour européenne des droits de l'homme rendu le 27/05/2025 dans l'affaire N.P. et V.P. contre la Bulgarie. La Cour a constaté une violation de la Convention en raison de l'absence prolongée de mesures facilitant les contacts entre un père et son enfant mineur. Le Comité rappelle l'obligation de l'État défendeur de mettre fin à la violation et d'effacer ses conséquences, ainsi que de prendre des mesures générales pour prévenir des violations similaires.
Procédure
La procédure relève du contrôle de l'exécution des arrêts de la Cour européenne des droits de l'homme par le Comité des ministres, conformément à l'article 46, paragraphe 2, de la Convention. L'État défendeur a transmis un plan d'action incluant des mesures individuelles et le paiement de la satisfaction équitable. Le Comité a examiné ces mesures et a conclu que la question des mesures individuelles était résolue, mais que celle des mesures générales nécessitait un examen complémentaire dans le cadre du groupe de cas Aneva et autres.

  Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having examined the action plan provided by the government indicating the individual measures adopted to execute the judgment including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2025)1169 );   Considering that the question of individual measures was resolved, given that the applicants have been reunited;   Recalling that the question of general measures required in response to the shortcomings found by the Court in this judgment continues to be examined within the framework of the Aneva and Others group of cases also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of the general measures required;   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case;   CONCLUDES that the necessary individual measures have been adopted;   DECIDES to continue to supervise the adoption of the necessary general measures in the Aneva and Others group of cases;
