Les demandes concernent des refus des juridictions internes de statuer sur les recours des requérants contre des décisions du Conseil de l'éthique dans le cadre d'un processus de sélection pour le poste de membre du Conseil supérieur de la justice. Les requérants invoquent une violation de l'article 6 § 1 de la Convention européenne des droits de l'homme relatif à l'accès à un tribunal.
Procédure
Les affaires ont été communiquées aux parties par la Cour européenne des droits de l'homme le 30 avril 2026. La Cour a posé deux questions aux parties : 1) L'article 6 § 1 de la Convention sous son volet civil était-il applicable aux procédures internes des requérants ? 2) Si oui, les requérants ont-ils bénéficié d'un accès effectif à un tribunal pour la détermination de leurs droits civils, conformément à l'article 6 § 1 de la Convention ?
