Le Comité des Ministres a examiné l'exécution de la décision de la Cour européenne des droits de l'homme Svanidze contre la Géorgie. La Cour avait constaté une violation du principe d'immediateté dans le procès.

Noting with satisfaction the decision of the Constitutional Court of Georgia which found the normative content of the relevant provision of the Criminal Procedure Code unconstitutional to the extent that it prevented substitute judges from re-examining or rehearing the case or specific evidence when necessary.   Having satisfied itself that all the measures required by Article 46, paragraph 1, have been adopted,   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case and   DECIDES to close the examination thereof.Citations
