IAFaits
Quatre affaires contre la République de Moldova ont fait l'objet de jugements définitifs de la Cour européenne des droits de l'homme (CEDH) entre 2007 et 2022. Les violations établies par la CEDH concernent des manquements à l'exécution de décisions judiciaires internes et des procédures judiciaires défaillantes.
Procédure
Le Comité des Ministres du Conseil de l'Europe, agissant en vertu de l'article 46, paragraphe 2, de la Convention européenne des droits de l'homme, supervise l'exécution des jugements définitifs de la CEDH. Le gouvernement moldave a été invité à informer le Comité des mesures prises pour se conformer à ses obligations, notamment le paiement des sommes allouées et l'adoption de mesures individuelles et générales.
Question juridique
La question porte sur la conformité des mesures adoptées par la République de Moldova pour exécuter les jugements de la CEDH et remédier aux violations constatées.

  Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:   -           of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and -           of general measures preventing similar violations;   Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;   Having examined the action report provided by the government indicating the measures adopted in order to give effect to the judgments including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2026)149 );   Recalling that the question of general measures required in response to the violation of Article 1 of Protocol No. 1 found by the Court in the Clionov judgment continues to be examined within the framework of the Olaru group of cases, also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of the general measures required concerning the failure to enforce final domestic court’s judgments;   Recalling also that the question of general measures required in response to the violation of Article 6 found by the Court in the Dunas judgment continues to be examined within the framework of the Godorozea group of cases, also in the light of the Court’s findings in this case, and that the closure of this case therefore in no way prejudges the Committee’s evaluation of the general measures required concerning the failure to properly summon for hearings;   Having satisfied itself that all the measures required by Article 46, paragraph 1, have been adopted,   DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases and   DECIDES to close the examination thereof.Citations
