Des demandeurs, des personnes physiques et morales, ont obtenu des décisions de la Commission des biens immobiliers (IPC) en 2014, 2017, 2018, 2022 et 2024, leur attribuant des compensations financières pour la perte de leurs biens situés dans la « République turque de Chypre du Nord » (TRNC). Ces décisions restent non exécutées à ce jour. Les demandeurs allèguent l'absence de paiement d'intérêts légaux sur les compensations et l'impossibilité d'exécuter les décisions de l'IPC sans une signature spécifique des autorités de la TRNC.
Procédure
Les demandeurs ont saisi la Cour européenne des droits de l'homme (CEDH) en invoquant les articles 6, 13 et 14 de la Convention européenne des droits de l'homme et l'article 1 du Protocole n°1. La CEDH a communiqué la requête aux autorités turques et a posé des questions aux parties sur d'éventuelles violations des droits des demandeurs en raison de la non-exécution des décisions de l'IPC et de l'absence de recours effectif.

The IPC ordered to pay the applicants awards for the loss of their property as a result of the events of 1974 (see details in the Appendix below); the enforcement proceedings are still pending. The applicants complain, relying on Articles 6, 13 and 14 of the Convention and Article 1 of Protocol No. 1 to the Convention, about the non ‑ enforcement of the IPC awards and the lack of effective remedies in that respect. In particular, the applicants allege that no statutory interest is payable on the IPC awards, and that it is not possible to enforce the IPC award until a special form is signed to that effect at a moment determined by the “TRNC” authorities. QUESTIONS TO THE PARTIES 1.     Having regard to the prolonged non-enforcement of the IPC awards, has there been a breach of the applicants’ rights under Article 6 § 1 of the Convention and/or Article 1 of Protocol No. 1 to the Convention, taken alone and in conjunction with Article 14 of the Convention (see Tunç v. Turkey , no.   54040/00, §§ 22-39, 24 May 2005; Amat-G Ltd and Mebaghishvili v.   Georgia , no. 2507/03, §§ 45-50 and §§ 55-63, ECHR 2005-VIII; Kuzu v.   Turkey , no. 13062/03, §§ 14-20, 17 January 2006; and Joannou v.
