Appendix to Resolution DH (97) 502   Information provided by the Government of Italy during the examination of the Ferrantelli and Santangelo case by the Committee of Ministers       The Ministry of Justice has sent a circular letter to all the criminal courts as well as to the prosecutor's offices attached to them in order to ensure the diffusion of the Court's judgment.   Moreover, in its judgment No. 371 of 2 November 1996, the Constitutional Court has declared Article   34, paragraph 2, of the Code of Criminal Procedure as unconstitutional, in so far as it allowed the same judge to take part in consideration of a person's guilt with respect to an offence, at several instances.   Hence, the Government considers that these measures will prevent the repetition of the violation of Article   6, paragraph 1, of the Convention found by the Court, and that Italy has accordingly fulfilled its obligations under Article 53 of the Convention.  Citations
