Italy (relinquishment) - 63386/16   Article 5 Article 5-1 Deprivation of liberty Confinement of a Tunisian national on board the ship returning him to his country of origin following a refusal-of-entry order issued at the Italian maritime border, his residence permit having expired: relinquishment in favour of the Grand Chamber Between 2014 and 2016 the applicant – a Tunisian national – lawfully resided in Italy. In May 2016, on his return from a stay in Tunisia, he was subjected to an identity check at the Italian maritime border while on board an Italian cruise ferry. The border police established that the applicant’s residence permit had expired at the end of March 2016, that the chief of police had refused to renew it and that the applicant did not have a visa to enter the country. In consequence, the police issued the applicant with a refusal-of-entry order, in accordance with the relevant legislation, and ordered the captain to return him to Tunisia. The applicant submits that, during the seven-day return journey, he was confined to a cabin that was locked from the outside and was under constant, strict supervision by the ship’s security officers. Relying on Articles   3, 5 and 13, the applicant complains of having been unlawfully deprived of his liberty on board the ship, of the material conditions of his accommodation on board and of the lack of a domestic remedy in respect of his complaints. On 20   February 2024 a Chamber of the Court relinquished jurisdiction in favour of the Grand Chamber.
