Greece (dec.) - 77574/01 Decision 3.6.2004 [Section I] Article 6 Civil proceedings Article 6-1 Access to court Dismissal of appeal on points of law on account of appelant’s failure to indicate his family status and the number and age of his children: admissible The applicant is a civil servant in the Ministry of Foreign Affairs. He works as an usher in an embassy. He brought civil proceedings to secure an increase in his expatriation allowance for dependent children. This action was dismissed at first instance but he was partially successful on appeal. The applicant appealed on points of law. The Court of Cassation dismissed his appeal. It declared certain grounds of appeal inadmissible on account of their vagueness, and criticised the applicant for, inter alia , failing to provide information on his family situation and the number and age of his children. This information was recorded in the case-file which had been filed with the appeal on points of law. Admissible under Article 6 § 1.   © Council of Europe/European Court of Human Rights This summary by the Registry does not bind the Court. Click here for the Case-Law Information NotesCitations
